    That article seems to be making the argument that rape isn't rape if the victim likes the perpetrator before the incident, or if the victim is unable to remember the incident.

    What I find really hilarious is inside the comment section of that article. Some of the posters are trying to blame the girl in some capacity or completely. Some, obviously Republican and still having some butt rash over the election, are trying to bring up Obama and the usual bawwwing over it.

    Back to the rapists: They are going to have both a hell of a big ass uphill battle and an even bigger lawyer bill regardless of the outcome. Now, if they have public defenders (I don't remember exactly if they do): They are fucked. Why? It means the more reputable and powerful lawyers weren't willing to step in because it is a potential easy loss.

    The defendant (a minor) now has to testify, so the defense attorneys have recanted their request for dismissal. Because, you know, it's a bit hard to testify about something you don't remember because you were roofied and drunk.

    This country is so back-asswards it's disgusting.

    That may work to put the final nail in these two's coffin. Think about it:
    1. If she can prove she don't remember shit, then the whole "it was consensual" shit gets thrown out the window.
    2. If she gets emotional, that can weigh heavy on the jury/judge's decision.
    3. If the two lawyers shred into her and her story remains the same, they will become the most hated lawyers in the US (next to the faggot who got Casey Anthony off).
    4. The Judge and/or Jury will get first hand accounts of the events through the eyes of the victim.
    Unfortunately, this means she will have to testify and have to relive the Hell she went through even if she has no memory. For that there is no avoiding. However, hopefully this bolster her resolve and courage. To do this must take balls of steel even if you don't have balls.

    1. Hopefully, but not necessarily. It could give the boys' "recollections" more merit. Something that may save this situation is that Ohio law says being drunk does not support consent, regardless of flirting/whatever she might have said. Unfortunately, she was not tested for roofies (which can stay in the system for as long as a month). That would've helped.

    2. The boys have already gotten "emotional" on MSM. It may be difficult for her to be emotional about things she doesn't remember, and may look insincere. By the way, a single juvenile judge is who will determine the outcome. He's not from that locale, and there is no jury, FYI.

    3. The problem is what story she will even have, with little to no memory. The evidence lies primarily in the instagrams, the videos, the testimonies of witnesses, etc. Hopefully, the judge will understand that. I'd like to hope that the dox from the Anonymous site will also be at least looked at, but that's iffy.

    4. Yes. Again, the unfortunate thing is she is reported to not remember much after the first party she attended.

    What angers me about her having to testify is that since media is allowed in the courtroom, her privacy/ anonymity will be gone forever. Being a rape victim is something that one carries and deals with for a lifetime, and it takes resolve and courage for all rape victims. I can't imagine the amount of additional and potentially long-lasting trauma of being a rape victim whose name is splattered all over the internet will bring to her.

    The defense spent plenty of time Wednesday trying to extract testimony that suggested the girl wasn't really all that drunk, laying the groundwork to suggest she was capable of consenting to sex later.

    Yet isn't a girl laying in just a bra in the middle of the street a sign of extreme drunkenness, especially after witnesses saw her drinking Stoli Vanilla vodka mixed with blue Slushee and at least one beer at a party?

    "I don't know," Madison said after court. "You've got to ask the person. Everyone is different. You maybe can handle your beer better than I can, you may have had a bad pot of collard greens earlier that day and the alcohol is not agreeing with your stomach. So that's a case-by-case basis. And that's what the law asks us to consider."

    It was a potentially fair bit of perspective until prosecutor Hemmeter quickly jumped to a one-question redirect of Pizzoferrato, pouncing on the chance to blow up the "she-wasn't-all-that-drunk-after-all" defense strategy.

    "Mr. Madison asserted you always make fun of the drunkest person in the room," Hemmeter said. "Was [the girl] the drunkest person in the room?"

    "Yes," Pizzoferrato said.

    "No more questions, your honor," Hemmeter concluded."

    I would've probably clapped after that one if I'd been in the courtroom. Glad the prosecutor is on the ball.

    Steubenville, Ohio, high school rape trial turns to texts, photos

    One of two high school football players in Ohio accused of raping a girl at a party last summer had pictures of the teen on his cell phone from that night, a state forensic analyst testified on Thursday.

    The pictures were among thousands of text messages, photographs and other files recovered from 17 mobile devices in the investigation, said Joann Gibb, a forensic analyst for the Ohio Bureau of Criminal Investigation.

    Steubenville quarterback Trent Mays, 17, and wide receiver Ma'lik Richmond, 16, are accused of raping the girl as she lay naked on the basement floor, too drunk to move or speak. The girl told police she did not remember what happened, but reported the incident the next day. They have denied raping her and say the sex was consensual.

    It is Reuters policy not to name rape victims.

    The case went viral on social media when photos and a video of the alcohol-fueled party were posted. The rape case in the Ohio steel town of Steubenville has drawn national attention and computer hacking group Anonymous organized protests accusing the town of covering up the involvement of more players.

    Gibb read pages of transcripts from text messages recovered from the mobile devices and confirmed photos that were entered into evidence as the trial continued into its second day.

    Data recovered from Mays' phone suggests the pictures were stored and also sent to other people, Gibb said.

    Gibb read sometimes graphic text messages between the girl and her friends, and between the accused football players and their friends in the days after the party.

    "I don't know who to ask or believe," Gibb said the girl said in a text to Anthony Craig the day after the party. Craig testified for prosecutors at the pre-trial hearing and was expected also to testify at the trial.

    Craig told her she was naked when he left for the evening and texted her that he could nothing about it. "I am sorry," Gibb said.

    Gibb said she then replied by text, "Who was there? Who did that to me?" and later, "I hate my life."

    Craig and two other members of Stuebenville's storied "Big Red" football team are expected to testify at the trial. They already testified against their two teammates in a preliminary hearing after receiving assurances they would not be charged for their actions that night.

    Mays and Richmond are on trial before visiting Hamilton County Judge Tom Lipps. If convicted, Mays and Richmond could have to stay at a juvenile detention facility until they turn 21 and then have to register as sex offenders.

    In brief opening statements on Wednesday in the non-jury trial, prosecutor Marianne Hemmeter told Lipps the girl was too drunk to make a decision about her welfare and promised to present evidence of the alleged rape culled from social media pictures and online postings.

    Lawyers for the boys say the sex was consensual and the victim had told friends in advance she wanted to have sex with the players. They also have said separating fact from rumor is critical because the girl remembers almost nothing from the night.

    HUGE hint in that that i think most people miss 1: IF it was "consensual" why did she report it the next day? 2: she texted "Who was there? Who did that to me?" and later, "I hate my life." yeah.....thats not consensual mates i bet my Honorable Discharge from the Army. the two boys lawyer missed that????? but someone with no schooling for a lawyer saw that and HE still claims their innocent. someone take his licence away PLEASE

    Agreed. Plus, even if she <allegedly> told her friends earlier in the day that she wanted to have sex with one/all of them, that doesn't mean she felt the same way by the time she was puking. People can change their minds. Even prostitutes can (and often are) raped.

    There is going to be a lot of nonsense during the trial, it's just lawyers trying to do their jobs, no point getting angry or analysing this kind of stuff until the trial is over. No one can do anything at the moment, the law has to run its course.
