The petitioners would like to bring their concerns regarding an investigation by Pittsburg County Sheriff Joel Kerns. The investigation includes the recent deaths of four patients: Stacy Dawn Murphy, aged 20, who died at Narconon Arrowhead Oklahoma on 19 July 2012; Hillary Holten, 21, who was found dead at the facility on 11 April 2012; 32-year-old Gabriel Graves, who died there on 26 October 2011; and 28-year-old Kaysie Dianne Werninck, also a patient at Narconon Arrowhead, who was found dead on 3 March 2009.

The families and public have waited for closure, but have been disappointed to learn of statements and a general lack of action taken by Joel Kerns, that could lead a reasonable person to believe he is not capable or willing to resolve this matter. In fact his actions could appear to show favoritism to the institution that he has the duty to investigate and clearly his public statements have been not impartial.

Narconon, is an organization currently embroiled in controversy regarding its pseudoscience detox program for drugs and alcohol. A number of deaths, human rights complaints and criminal investigations around the United States and other nations have been well covered in the press. A number of Narconon Arrowhead staff have in fact lost their counseling certification, revoked by the National Association of Forensic Counselors (reported by Channel 2 KJHR) and the facility has reportedly been put on probation by CARF, the organization which certified Narconon Arrowhead. The Oklahoma State Bureau of Investigation (OSBI) completed its investigation in to the death of Stacy Dawn Murphy and handed its findings back to Sheriff Kerns in July of 2012, he has also stated that he has conducted interviews and his investigation is ongoing.

Yet recently Sheriff Kerns has made statements to the press that makes it appear as if he is sitting on this investigation and could be protecting Narconon:
May 24, 2013 -- Fox News video interview of Sheriff Joe Kerns. "Everything we found seems to be in order. I know for a fact they are trying to save people's lives to get them off drugs." And "I would rather have a live Scientologist than a dead kid" (Naconon is a known Scientology front group.)

A review of call records to emergency services also show a disturbing history that should investigated by the state. These logs include:
A sexual assault on a staff member that Narconon refused to report to law enforcement and the perpetrator’s own father had to report him.
A report of a staff member who was in fear of Narconon and he needed a police escort to collect his belongings after the death of Stacy Murphy.
Cases where individuals attempted to commit suicide and were not removed until other attempts were made to kill themselves. Narconon is not a mental health facility and has no authority to care for such people. No action taken by law enforcement.
Complaints of people trying to escape from Narconon and being held against their will, asking law enforcement to recover runaways, when they have no legal authority to do either.
Also there have been a number of interviews with ex-employees, patients, and supervisors of Narconon Arrowhead that have stated staff supplied drugs for money and sex and that Narconon held people’s medicine without the medical authority to do so and other like abuses.

It has also come to light that two depositions have been taken in the civil lawsuit regarding the death of Stacy Dawn Murphy. Each of these Depositions were approximately six to seven hours in contrast to a Pittsburg County deputy sheriff only speaking to one of these persons for about fifteen minutes. The lawyer conducting the depositions was Gary L Richardson RRBK PLLC Law Tulsa, Oklahoma 74136 (former US Attorney, head of investigations for the State of Oklahoma Insurance Dept, and former State Prosecutor.) He has publicly expressed outrage over the comments made by Sheriff Kerns and the lack of action by his department. He has also indicated that those he deposed had information that would be of value in a criminal investigation but were never or poorly explored by the Pittsburg County Sheriff’s Department.

In the face of overwhelming evidence about the bad conduct and unethical behavior of Narconon Arrowhead and Sheriff Joel Kerns statements, how can anyone believe he could be acting in good faith? Lastly Narconon Arrowhead is the largest employer for the town that it is located in (Canadian OK) and Sheriff Kerns is an elected official for that area; there are obvious concerns there as well that call for an independent state level investigation. Therefore the petitioners are informing your offices that action must be taken to resolve this matter and we are publicly calling for you to take charge of this case and insure the public trust.

During a new interview with Janna Clark of Fox 23 Tulsa in 2013 Kerns made some rash comments while the investigation was still ongoing by the OSBI.

Gary Richardson, the attorney representing the families, was livid after hearing Sheriff Joel Kerns comments.

Richardson says for Kerns to speak this way about a facility which is technically still under investigation is outrageous.

“I’m a former US attorney, I’m a former state prosecutor, and I’ve been over investigations for the state insurance division at one time. And I think I can tell when someone is trying to uncover the truth,” he says. “I’ve talked to some people who, if [the sheriff’s office] was trying to figure out the facts of that night, they would have asked more questions. And some they didn’t even talk to.”

On the other hand, the Oklahoma State Bureau of Investigation is still actively gathering information. “I furnished a deposition yesterday to the OSBI,” he says.

“For Kerns to go on television and say ‘Everything we’ve found seems to be in order.’ That statement itself tells us he’s calculating what he’s saying. In my opinion they haven’t tried to find anything. He’s saying that Narconon is A-OK, even though they’ve had four deaths in recent months,” he says, referencing the March 2009 death of 28-year-old Kaysie Dianne Werninck, which is also under investigation.

“It angers me to have a law enforcement officer go on the air and say the things he did when supposedly they haven’t said the investigation is closed. It angers me because I’m close to the families of these deceased young people, and I know the pain and anguish they’ve been through. I think it’s extremely reckless of him to do that,” Richardson says.

Legal action has shifted away from lawsuits against CoS to lawsuits against front groups that have no protection from "ministerial exception." This makes things easier, but we are now seeing major road blocks in the form of subversion by OSA of elected and appointed government officials, particularly with Sheriff Kerns in Oklahoma, and CCHR subversion on "children's health" and drug issues across the country.

Sheriff's house burglarized, son arrested. Will Sheriff Joel Kerns send his son to Narconon or, did he already.

  Speaking of his son, Sheriff Kerns said, “He was released to us from the jail, and from the jail we went to a rehabilitative center.”

Joel Kerns said he personally took his son directly to a drug rehab center following his son’s release from jail.

“We had no objection to his being released on his own recognizance as long as he went to a treatment facility,” Ward said.

There will be a new state senator in town if Joel Kerns wins his next political race.
Kerns, who doesn’t plan to run for re-election as sheriff, said he’s officially announcing his candidacy as a Democratic candidate for District 7 state senator. The sheriff is challenging incumbent state Sen. Larry Boggs, R-Red Oak, for the post Boggs won in 2012.

A primary election for the state senate post will be held in June 2016, with the general election scheduled for next November. That gives Kerns, who calls himself a “gun-toting, Bible-thumping preacher’s kid,” time to complete his current second term as sheriff.

He said he can help the people of District 7 by serving as state senator. The sprawling district includes all of Pittsburg, Latimer and Hughes counties, much of Hughes County, excluding Holdenville, and a portion of Okfuskee County.

“I think I can make a difference,” Kerns said. “The position I’m in allows me to see some of the things that need to be addressed.” He said that includes issues such as health care, mental health care, drug addiction and preventative measures to keep people from going to prison, including rehabilitative education programs.

Kerns referred to his “Not Me” program, which involves taking jail inmates to schools in the county where they can tell students in the seventh through twelfth grades of their personal stories that got them in trouble with the law. Kerns said he had stopped the program for a year, but he plans to reinstate it

“That’s privately funded,” Kerns said of the program. “It doesn’t cost the taxpayer.”

As senator, Kerns said he would focus on other preventative programs, including more mental health services for drug and alcohol addiction.

“Southeast Oklahoma is different than Tulsa or Oklahoma City,” Kerns said. “We don’t have all the capabilities of centers that are willing to help.” Kerns said that while there are local facilities, such as the Oaks, the local centers need more funding.

“The solution is education instead of incarceration,” Kerns said.

He said he knows firsthand how drug addiction can affect a family.

“If you’re not affected by that, you need to count your blessings,” Kerns said.

His son, Braden Kerns, is currently serving time in a drug offender work camp following his conviction on burglary charges the sheriff thinks was related to drug addiction. Sheriff Kerns made one of the calls to McAlester police that resulted in his son’s arrest.

“He’s my son and I love him and we tried everything we knew to get him help, but it did not help,” Joel Kerns said. “By sending him to prison, hopefully we can save his life.”

Kerns also addressed other issues, such as public education?

“We know there’s a problem there,” Kerns said. “We know funding is going to get considerably harder to find to keep our rural schools open. I’m not so much on David Boren’s one-cent sales tax,” Kerns said, referring to a proposal from the University of Oklahoma president regarding a one-cent sales tax for public schools and higher education funding. Kerns said he’s for finding other ways to fund education.

Another issue is corrections. Kerns said he started his law enforcement career as a correctional officer at the Jackie Brannon Correctional Center before transferring to Oklahoma State Penitentiary.

“Since 1907, this has been one of our mainstays,” Kerns said, referring to state corrections. “It’s a decent, reputable job than not everybody desires,” Kerns said. It goes back to the old adage everybody wants offenders locked up, but nobody wants to pay for it, he said.

Kerns said he’s opposed to housing state inmates in private prisons.

“We have the facilities and the guards here to take care of them without having to send them to private prisons,” Kerns said. If elected to the state Senate, he would definitely like to serve on the appropriations committee for the Department of Corrections, said Kerns.

Asked about economic development, Kerns said “I don’t want to do (Oklahoma Lt. Gov) Todd Lamb’s job, but I think with our water and our state parks, we can utilize them to bring wealth and income back to our counties.” Kerns said he was referring to places such as Lake Eufaula, Robbers Cave State Park and Sardis Lake.

“We have what everybody wants; we have the scenery,” Kerns said.

“I try to explain to everybody that garage sales and resale shops are good, but we don’t need them on our main highways coming into our towns,” Kerns said. “We’re going to try and bring more businesses to our already-developed industrial and state parks.” By that, Kerns said he was referring to U.S. Army Corps of Engineers parks that have been headed by private individuals or groups. He said he’s not referring to privatizing places such as Robbers Cave State Park, because it is maintained by the state and already generates an income.

What about questions regarding the sale, transport or piping of water from southeast Oklahoma to other places?
“I am 100 percent for keeping our water here,” Kerns said. “I was raised by the South Canadian River. By no means send our water to Texas or Oklahoma City.”

He plans on being accessible as a state senator. “In the past, we’ve had two Democratic senators and everybody knew them, good or bad,” Kerns said. “It’s a job that people need to know you are doing something.
“I personally want to rejuvenate this part of southeastern Oklahoma,” he said.

Kerns and his wife, Darcy Kerns, have two other adult children, Katie Talley and Jaelon Kerns.
Regardless of how the senate election turns out, Kerns said he’s committed to finishing his second term as sheriff.

“The people elected me and I’m going to serve the full term,” he said.

After that term is completed though, he’s ready to serve as the District 7 state senator if he wins the election.

“We’re not going to let Tulsa and Oklahoma City be our voice,” Kerns said. “I want to be the voice.”

The state Department of Mental Health “buried” an inspector general’s report recommending that Narconon Arrowhead be shut down after three patients died there, two lawsuits against the agency claim.

Specifically, Poff says she was investigating the 2011 death of Gabriel Graves and the 2012 deaths of Hillary Holten and Stacy Murphy when she “determined that Narconon violated numerous state laws and recommended that the facility be shut down by” the state.

She alleges that the leadership of the department “was afraid to take on Narconon in litigation because there is significant financial backing of the facility by the church of Scientology.”

Kerns will soon learn the bitter end (as others have in the past) that you should never make a deal with Scientology (NARCONON).
Any credibility he once had (if he had any before) is now gone.
If any more people get injured or pass away at this scam facility with it's quack treatment, then it will be on Kern's head now too.

You're absolutely right, they should be reinstated.
Oklahoma was and is afraid of the past. CoS bankrupted Oklahoma's legal budget in the early 1990's for denying Narconon Chilocco it's permit. Finding it as:

The Board concludes that the program offered by Narconon Chilocco is not medically safe.

This string of deaths at Narconon, and the organization’s methods of treating drug and alcohol addiction, have gained national attention.

The deaths have also gained the attention of local, state and federal law enforcement agencies. Pittsburg County Sheriff Joel Kerns told the News-Capital on Monday that his office has completed its recent investigation.

“Our investigation is complete,” Kerns said. “And the final report was turned over to the DA on Friday and the DA’s office will determine if any charges are to be filed — criminally or in terms of negligence.”

An OSBI spokeswoman said the sheriff's office is leading the investigation and deferred questions about the investigation to Sheriff Joel Kerns.

Historically, candidates have failed to complete our test due to the advice they receive from their parties and advisors and out of fear of negative attack ads. Two men connected to the embattled Narconon Arrowhead say they consider Pittsburg County Sheriff and state Senate candidate Joel Kerns unqualified, saying he didn't do enough to investigate the drug rehab center, where a string of deaths drew national attention.

When asked for comment, Kerns said he couldn't see the link between his role in the investigation at Narconon Arrowhead and their experiences with the facility, saying his department carried the investigation as far as they could before it was handed over to different agencies.

Robert Murphy, whose daughter was the third patient to die at Narconon Arrowhead between 2011 and 2012, and former patient at the center, Colin Henderson, held a news conference Tuesday in which they challenged Kern’s fitness for District 7’s state Senate seat.

Both said they were "appalled" that someone who failed to prevent the Narconon deaths was seeking government office.

Murphy's daughter, 20-year-old Stacy Dawn Murphy, died at the center in July 2012. Her death followed those of patients Gabriel Graves in 2011 and Hillary Holten in 2012.

Murphy and his wife sued the rehab facility in 2013 over his daughter's death. He said if Kerns' department had properly investigated the previous deaths or complaints, she might still be alive.

"As far as I know, we did everything feasibly possible that we had our means to,” Kerns said about the investigation.

Murphy and Henderson's criticism hinged in part on newly discovered information revealed in a deposition with Kerns.

In the deposition, Kerns reportedly said he did not speak with anyone from Narconon Arrowhead during the investigation, did not review surveillance footage from the facility and never read the OSBI's final report into the deaths.

These statements coupled with a 2013 TV news interview Kerns gave, in which he says his department's investigation found nothing out of order at the facility, prove he's unqualified, Murphy and Henderson said.

The deposition will be made public when Murphy's case goes to trial, Henderson said.

When asked about the apparent contradiction between his on-air statements and the deposition, Kerns said he couldn't comment because of ongoing court proceedings.

"I really can't even comment on what I did say," Kerns said.

“Anybody with any common sense could have seen what was going on in Narconon and pushed for its closure, so in my opinion, I feel he is responsible for those who lost their lives out there,” Murphy said.

Kerns' department conducted the initial investigation before it was turned over to the Pittsburg County District Attorney's Office, he said Wednesday.

The OSBI completed two partial investigations at Narconon related to Stacy Murphy's death. Kerns first called them to assist documenting the crime scene on July 19, 2012, bureau spokeswoman Jessica Brown said.
The district attorney asked for the agency's help again in March 2013 to interview witnesses about Murphy's death, Brown said.

Murphy's attorneys are seeking a date for a jury trial. They filed an application to set a pretrial conference Oct. 24, according to online court records.

Neither Murphy nor Henderson live in District 7 and said they wanted to expose Kerns' "incompetency" to help voters.

“We have no stake in the race at all, and all we want is the constituent base to be informed to cast a vote that counts,” Henderson said.

The two alleged that the initial deaths should have warranted a more thorough investigation from the Sheriff's Office before more people died.

Kerns said personnel at the McAlester hospital administered medical aid to his son but he died early this morning.
"I loved him," Joel Kerns said.

The state Medical Examiner is expected to perform an autopsy to determine the cause of death, the sheriff said.
