Two Canada teenagers are due in youth court today on child pornography charges related to a deadly cyberbullying case. One 18-year-old man on Thursday faces two counts of distributing child pornography, while another 18-year-old man is charged with distributing and making child pornography.

This is interesting

The province enacted anti-cyberbullying legislation the day before the child porn charges were laid last week. The new legislation gives victims the ability to sue alleged cyberbullies, or their parents if those accused are minors.

An independent review released in June concluded the Halifax regional school board could have done a better job but was hindered by the fact that Rehtaeh was often absent from class.

Able to sue people who rape you and then post your image is one thing. But who decides what is and what isn't cyber bullying...there is a thin line. My heart breaks for Rehtaeh and her family. Please don't misunderstand, I hope these pukes get what they have coming. Just saying,give em an inch kinda thing.

The two teenagers facing child pornography charges in connection with the high-profile Rehtaeh Parsons case are due back in a Halifax court later today.

One 18-year-old is charged with creating and distributing child pornography. The other faces two distribution charges.

The suspects cannot be named because they were minors at the time of the alleged offences.

Both are charged under the Youth Criminal Justice Act.

Parsons was taken off life support following a suicide attempt last April that her family says was prompted by relentless bullying.

They said the 17-year-old girl was bullied after a digital photograph of her allegedly being sexually assaulted in November 2011 was passed around her school.

The two suspects are due in provincial court at 1:30 p.m. AT Thursday.

HALIFAX – An Eastern Passage man connected to the Rehtaeh Parsons case has been charged with uttering death threats online.

On August 2, 2013, police received a complaint from a 49-year-old man who said he was threatened by an individual through comments on YouTube and WordPress.

RCMP say search warrants were executed to obtain IP addresses, and a computer and electronic storage devices were seized from a residence on Peter Court in Eastern Passage.

A 19-year-old man was arrested at a Peter Court residence on Thursday night.

A teen who admitted to taking a picture of a girl allegedly being sexually assaulted by a 16-year-old will serve no jail time and will also avoid probation.

The 20-year-old, who was 17 when the crime was committed, was sentenced to a conditional discharge and will also have to give a DNA sample, according to the CBC's Blair Rhodes.

Police had previously determined that there was not enough evidence to pursue sexual assault charges against the teen involved in the sex act.

Victim Rehtaeh Parsons was bullied for more than a year after the photo circulated amongst the boys' friends, according to CNN.

Parsons tried to hang herself in April, 2013 and died three days later after she was taken off life support.

Before handing down his sentence, Judge Gregory Lenehan said the defendant's actions led Parsons to "fall into a deep dark hole of despair from which she could not extricate herself."

But Lenehan also said the defendant "is not as morally blameworthy as an adult would be."

A 19-year-old Eastern Passage man pleaded guilty Monday in Halifax youth court to one count of distributing child pornography.

He admitted sending two young women a photo that showed him having sex with Rehtaeh, then 15, from behind while she vomited out a window in November 2011. The photo was subsequently circulated on social media to numerous young people, many of whom attended Rehtaeh’s high school.

Rehtaeh Parsons' family 'unbelievably happy' now that she can be identified

The father of Rehtaeh Parsons said her family is "unbelievably happy" that no one will be prosecuted for identifying the Nova Scotia teen, who died following a suicide attempt last year.

The province's attorney general announced Wednesday that no members of the media will be prosecuted for identifying Parsons, so long as her name is not used in a derogatory manner.

A mandatory ban on identifying Parsons was imposed in May, as the case against two young men charged with child pornography offences got underway.

Parsons was just 17 when she was taken off of life support following a suicide attempt in April 2013. Her family said she had been sexually assaulted in 2011 and was subjected to months of online bullying as a result.

In November, one of the suspects pleaded guilty in youth court to distributing a sexually graphic image of a 15-year-old girl. He is due for sentencing in January. The other suspect was given a one-year conditional discharge, after pleading guilty to making child pornography.

Glen Canning, Parsons' father, told CTV News Channel that it had been an emotional morning for him, as Attorney General Lena Metlege Diab notified him early Wednesday with the news.

He expressed his joy in a tweet, writing: "Rehtaeh Parsons is her name. Today I'm hoping to get my daughter's name back. #OpJustice4Rehtaeh."

He said the entire family had been against the publication ban from the beginning. "We are just unbelievably happy right now. It just seems like Christmas came a bit early this year for us," he said.

Canning said it is very important to him and the rest of Parsons' family that her name and story be part of the public record.

"Her case has been extremely unique, and it had a big impact on an awful lot of people," he said. "It's changed a lot of things, laws have changed in Canada and laws have changed in Nova Scotia.

"I believe she had a huge impact – not only on cyberbullying and bullying, but also on issues of consent and sexual assault."

While the judge presiding over the case noted in May that he was required by law to implement the ban, he said it was ultimately up to the Crown prosecution service whether to prosecute cases where the ban had been broken.

Then on Wednesday, Diab issued a directive announcing that “no breach of the ban” will be prosecuted. She said she had come to her decision after much consideration.

"I carefully considered the original intent of the law to protect victims, and I listened to the views of Rehtaeh's parents, supporters, legal experts and Nova Scotians. This directive strikes the right balance," she said in a statement.

Martin Herschorn, Nova Scotia’s director of public prosecutions, told CTV News Channel Wednesday that “unique” public interest factors, including the fact that Parsons’ name had been widely reported before charges were laid in her case, led to the decision on the publication ban.

“People can feel confident that they can discuss the case and her name associated with it without fear of prosecution,” Herschorn said.

Police said they have investigated several complaints since the ban was imposed, but they have not laid any charges.

Last month, after one of the suspects pleaded guilty, the Halifax Chronicle-Herald identified Parsons as the victim, breaking the ban. No charges were laid.

Even the judge who imposed the ban thought it was stupid, but it was automatic in child pornography cases.

HALIFAX—A groundbreaking anti-cyberbullying law passed a matter of weeks after Rehtaeh Parsons’ death could face its first serious charter test in a Halifax courtroom Friday.

Lawyer David Fraser is awaiting two decisions from a Supreme Court of Nova Scotia justice: one to determine whether messages between his client and a former business partner should be considered cyberbullying.

The next decision will determine whether Fraser can launch his argument that the provincial Cyber-safety Act is unconstitutional under the Canadian Charter of Rights and Freedoms.

“The problem is the legislation is so broad that essentially anything you do that hurts somebody’s feelings online in Nova Scotia is cyberbullying,” said Fraser, who has been an outspoken critic of the law.

Justice Glen MacDougall is expected to rule on whether Fraser’s client, Robert Snell, cyberbullied Giles Crouch when the two got into a dispute. Crouch sought a cyber safety protection order against Snell last December that prevents Snell from communicating with Crouch.

Fraser said he sees the Nova Scotia law “as an unreasonable and unjustified infringement of freedom of expression rights under the charter.”
