The email used to make the false claims was "gary.scarff@peephole.tv". Someone would first need to have access to Schaper's porno business email domain name in order to make an email account there.

Hi guys.

I thought of another possible angle on the restoring of the Youtube videos. The videos taken down all had numerous comments, many by americans who were using the internet to claim their right to freedom of speech. By taking down the videos Youtube is violating the First Amendment for all those citizens who posted comments.

This could bring a whole new power of persuasion just by driving this point home to Youtube, and if a Class action lawsuit were brought on behalf of those unconstitutionally victimized commenters it could change the face of free speech linked to videos on the internet.

The First Amendment applies to Congress... and through Supreme Court decisions, the executive and legislative branches, state and local governments.

Well, isn't Youtube a public forum by a publicly traded company? How is that private?

It has no government funds meaning while it's publicly traded it is a private company.

But the government has YouTube channels now:
AFP: US Senate, House launch YouTube channels

I they paid for those, YouTube might be seen as a government contractor, which might have some other rules apply to it.

The channels are private labeled so my guess is that they are paid for.

As a government contractor they have to follow many rules one of them though is not how they run their business (EOE/sexual harrasment etc excluded.)

I see those points, but in the case of Youtube taking down Anonymous videos and thereby taking down hundreds or thousands of freely expressed comments they are acting on an outside source's intention and are agents for the DMCA claimant. Amirite or do I suck c....well let's take that as a given, LOL.
