    I don't care what people choose to do. I like discussion. As for what I have or haven't done, who knows? Maybe I've never done anything and have nothing to do with Chanology, or maybe I'm the most active person in chanology. But I really don't see any leaderfagging. I'm not demanding that people do anything.

    I merely provide my own perspective, as does everyone here. There are many clever, creative ideas here. If you look at my posting history, there isn't a large number of different threads in which I have posted. I simply open my mouth when I see something that I think is... off shall we say.

    A Norwegian argues US constitutional law:

    I disagree on the why and how, but not on the end result.

    If I understood correctly, Hein deals with the discretionary executive resources which was spent for facilitation of the faith based initiative (the money used to hold conferences and meetings and so on) not the actual funding which was given to the participants.
    The actual money which was given to the participating organizations were given out without any difference shown between religious and non-religious service providers, and the service providers would keep separate accounts and not discriminate between people recieving benefits. That is all on the up-and-up.*
    So the plaintiffs in Hein instead tried to attack the faith-based initiative on the money used to recruit and prepare faith-based organizations to apply for this money. (Under the theory that the administration in concentrating on faith-based groups in this work were establishing religion just by using some time and money.)

    I think if you tried to sue based on Narconon getting money, Hein would not apply to your case, and you'd probably have standing, but you would probably still lose if Narconon competed on equal terms with other service providers. The standing would all depend on exactly which budget it's coming from, and who gets the money.

    Let me give an example: If the president chooses to go visit Narconon, or to invite Narconon for a conference on drug treatment, paid from the president's executive funds, you might argue that it shows a favor to one religion over another, but Hein means you can't sue - you have no standing. If, however, Narconon is getting preferential allocations of drug abuse treatment funds tasked by congress, you would have standing to sue.

    Even if you have standing, and even if you were able to get the court to agree that Narconon was religious**, you would lose if the grant was given on equal terms with other applicants - that is, if the government agency ignored the religious connection when allocating the funds, they were doing it right.

    Suing to stop Narconon funding would be better based on
    - Showing that the money ends up in Scientology.
    or
    - Showing that the treatment is not evidence based - that it is a faith healing program. Many countries now demand that alternative treatments are either evidence based or religious - not this strange land in between where Narconon festers.

    (*: At least it used to be considered on the up and up. The Obama admin is considering to force participanting organizations to even let anyone work on the service programs without &quot;discrimination&quot; - so you could have a church having to let satanists or KKK people run their soup kitchen in an extreme case. Going a bit further than needed - but hardly a terrible outrage either.

    **: Arguing that Narconon is religious seems to jar with making an argument that Scientology is not a religion. Personally, I am unsure if they are a religion, but I am sure that their &quot;fixed donations&quot; (course fees) should be taxed.)

    Back to Measurable Solutions: Could you speak to the civil rights division in the DoJ about this case? I think that might be a productive use of your time. Even if they might not start a case without a victim willing to press charges (they MIGHT), you will at least learn what kind of evidence they would be looking for and if they would be interested at all.

    That's incorrect--neither the plaintiff nor the court made any distinction between facilitation and actual funding. The complaint was as to "the use of money appropriated by Congress under Article I, section 8, to fund conferences that various executive branch agencies hold to promote President Bush’s 'Faith-Based and Community Initiatives.'" I think you're misreading that the complaint attacks the use of money used to "fund conferences..." as limiting its reach to only "facilitation." The complaint only targeted money used to fund conferences because winning on that point would've effectively dismantled the entire Office of Faith Based Initiatives. If the complaint had targeted individual expenditures to religious groups, a court could have ruled narrowly, invalidating the expenditure but leaving the Office intact.

    The Court's response most certainly reaches all executive branch expenditures, however, whether they be for "facilitation" or "actual funding". Alito wrote: "Because almost all Executive Branch activity is ultimately funded by some congressional appropriation, extending the Flast exception to purely executive expenditures would effectively subject every federal action—be it a conference, proclamation or speech—to Establishment Clause challenge by any taxpayer in federal court."

    The decision to attack money used to construct the FBO was tactical but the Court's response covers any expenditure made by the executive branch. Remember that it all comes back to Flast--the question was whether Flast is broad enough to encompass executive branch expenditures, not whether Flast is broad enough to encompass certain types of executive branch expenditures but not others.

    And if one were to go to court to challenge SAMHSA expenditures made through the FBO, the initial question would not be whether it could be distinguished from Hein but whether it would fall under Flast, a question which would only then necessitate an examination of Hein for the answer; and Hein would not be read so narrowly as to include only expenditures for facilitation and office construction. If the Supreme Court intended to restrict itself to such a narrow factual basis, it would've deliberately done so.

    That's pretty much correct--the problem with the hypothetical establishment clause suit would be showing that NN was treated more favorably than a secular entity because of its religious character. Even if this was true it would be very difficult to prove because those invovled in the approval process, even if they were making such constitutionally violative distinctions, do not leave a trail of easily discoverable evidence, generally speaking.

    It really just comes down to personalities in the DOJ and whether a suit would fit within its mandate. Obama's DOJ is likely to pursue different types of cases than Bush's DOJ did--and mostly for the better--but I don't get the feeling that any religious group, no matter how flaky, will get much attention from Obama's DOJ. The DOJ generally tries two types of cases--cases that fit within its mandate, and cases that fall outside the mandate but which can't be ignored, whether because of publicity, egregiousness, or a crime's systemic character. As to types of evidence, the DOJ would mostly be looking at documentary evidence of the type that Francie has posted here. I personally think that the chance of the DOJ getting involved is low.

    Yes, you're right. And if they had targeted the congressional grants, they would have had standing, but probably lost because the funding was given without religious considerations. (Or at least it would have been hard to prove.)

    If, however, the case had involved substantial executive funds actually given to faith groups, I think you would have seen a more interesting case. The chance of a different outcome might not be high; the facts of the basis of the case do hold some influence on the outcome of a lawsuit, but I'm sure the justices gave due consideration to the principles at work here and considered how their ruling would work even if the White house had decided to give millions of dollars directly to the Church of the American Knights of the KKK.
    And Alito's majority opinion says that if something like that were to happen, it would be job of Congress to intervene, or that a lawsuit could be brought by people who have standing not as a taxpayer but as something else.

    If Congress failed to act in this hypothetical case, perhaps you could argue that you could even get standing as a tax payer again - since Congress lets the White House make a substantial direct contribution to the establishment of religion? Maybe a new precedent would be made? And in this case, perhaps the argument would center on whether or not money was only spent rather than given, or maybe it rather would center on if the expenditure was so substantial and so alien to the purpose of the White House that it should have been treated as its own budgetary item.

    Anyway, this has become a bit of a tangent. Thanks for providing your insight.

    Actually, yeah. There were some new docs filed on the court's website and I now have them but haven't had time to update. They're motions related to discovery, specifically a motion to quash subpoena requests--Diskeeper is seeking to subpoena the plaintiffs' former employers. I'll get to it over the next few days.
