    It will probably take civil lawsuits to bring sufficient attention to the labor, wage, abuses, and trafficking in sufficient magnitude to get hard attention from civil authorities. For that reason, I heartily support all such lawsuits.

    Also, when scientology is pressured, they fuck up royally. Cases such as Headley's is putting enormous pressure on scientology and they ARE fucking up. The big fuckups become public and make for yet more press and case against scientology.

    There's no way scientology can "keep in their TR0" on this case (keep their composure and not show their poor deal of cards). They are dancing like a puppet out of control like it's being run by an autistic kid intent on destroying the puppet.

    The actually awesome thing about this case is they are put into a position of defending paying their people slave wages.

    They can't actually win, meaning if they win,,,they lose. If they lose...they really lose.

    5000 Sea Org members currently.
    $250,000 weekly pay being paid now (if they get paid each week)

    8000 Staff members worldwide currently (between that and the 20,000 public that is their entire membership, high average) usually they get paid less or about the same as SO, sometimes more but not routinely.

    98 hours per week min wage x 10,000 people per week times 52 weeks per year.

    Maybe only 80 hours for staffers. Who knows, probably would work more hours if they were being paid by the hour.

    Boatload of cash no matter how you calc it. 400 mil sounds good and is big round number that stands up to the calcs somehow or another.

    Somebody could lay it out and maybe it would be more than 400 Mil.

    The formula I came up with is that one staff member generates $19.64 per week based on an average of 14,000 persons...and I am shooting high.

    I didn't mean to doubt the 400M but am still uncertain as to the number. I think it would be safe to say that Scientology is underpaying their employees.

    If part of the wages are considered room and board I imagine that is where the human trafficking / slavery comes in.

    The point is the information needs to go to the correct agencies as soon as it is discovered. If not the people with holding the information are in a way, as guilty as DM even though they may not be legally liable. Once all the information is given if the government does not choose to act it is on their hands. That will make them liable in the eyes of the public if not the courts and encourage the change to prevent this from happening again.

    I could not agree more. This case (these cases) are full of win and potential win no matter what as they are getting the truth out. And, one way or another, the truth out will help bring about a great justice even if only drying up the potential public they can fool and financially/spiritually rape.

    With all the postings by people with considerable knowledge of and interest in law, it is surprising that no one has brought up the Labor Code Private Attorneys Act of 2004. (Labor code §2698 et. seq.) A little history here may answer some of the questions about the role of civil litigation in enforcing labor laws, and why this case was not filed as a class action.

    Under California Labor Code §2698 et. seq., private counsel may seek civil penalties in a class action. The California Department of Industrial Relations lacks the resources to properly enforce the labor laws. Private civil lawsuits are expected to fill some of the void. Civil penalties are not wages and are usually only recoverable by state agencies and their counsel. Under this somewhat unusual law, private counsel may enforce the labor code and recover civil penalties. The penalties are split 25% to employees and 75% to the state. The civil penalties can be $200 per employee per pay period. If there are 5000 Sea Org members working for illegal wages, the potential civil penalties are in the millions.

    This case started as a potential class action under the labor code for civil penalties. We noticed the proper authorities of labor code violations. For various reasons, including the withdrawal of potential class representatives and a one year statute of limitations for recovering “penalties” as opposed to wages, a §2698 class action on behalf of BFG alone would have been problematic. As filed, Marc’s case seeks wages, not civil penalties, but the case also has the potential of generating findings and orders that can be taken to the Department of Labor for enforcement action by the state.

    We cannot put David Miscavige in jail; however, the civil action can recover wages for plaintiffs and create a scenario where, as a practical matter, Scientology cannot continue its blatant abuse of workers. IMHO, if you wait for the state to do this on its own, it will not happen.

    For you class action fans, please be advised that we do have a class action expert in consultation. As far as we know, there has never been a human trafficking class action. But, someone has to be the first. Nor further comment on class action would be appropriate at this time.

    Dude as you said Moxon's own daughter fucking died there.. if he didn't care then what makes anyone think he'll care now.. personally I want to see that fucker fry for his crimes.. sorry but he was heavily involved in Snow White and Freakout and was rumored (STRONGLY) to have been the guy giving orders to murder judges pets...     See here's the problem. You're assuming that he would have thought that scientology had something to do with his daughter's death. People like him are too strongly indoctrinated and, given their level of commitment probably can't accept the fact that something they think is so great and important could lead to tragedy.

    I guess I am assuming that one would view their childs death from a RATIONAL standpoint so you do have a point there... BUT as a parent myself I can't see how anyone COULDN'T make that connection..

    Criminal cases against CoS are nice. They are rather more difficult to come by.
    We'll take the ones we can.

    I guess civil cases against various random anons and OG really shouldn't be our priority either; its only criminal cases that show evidence of our crimes that merit attention.

    Anyway,
    I hope Marc takes your advice to heart and stops this feeble effort before it gets out of control and more innocent Scientologists get their names muddied.

    A cottage industry in labor code enforcement suits based on nearly identical theories and nearly identical actions by Scientology, much easier to prosecute than the original. Scientology is stupid if they don't settle this in the hopes that nobody else picks up on the idea. Actually losing this case would be a complete catastrophe for the cult business model.

    The penalty class action suit needs a class representative who satisfies the one year staute of limitations. Those out less than a year are still too afraid to sue. If I had a one year class plaintiff, there would be such a suit. There couild be interesting court orders regarding notice and opt out procedures. Notice to all California employees could be ordered by the court. Still to come-perhaps
