    Graham, I thought you were a lawyer. Why not ask for affidavits about the evenings events at the Westin, instead of sending a "letter" (very loosely used term) to the Dept of Justice with a mix of scilon lingo and anon slang. You can't seriously be linking to and quoting from a forum in regards to a perceived "abuse" you suffered here.

    You do realize the Westin staff had told a few protestors to leave the property and if they came back it would be trespass -- well before the dinner escapades. This is well within their rights, especially with a lively protest taking place outside because a group rented their facilities inside. I get the part about complaining about the staff and even the public sidewalks.. But what is the deal with this whole "restaurant affair". Did you really get screwed that bad out of your leftovers?

    I thought you were a smart lawyer. You really can't foresee what happens when the DOJ lackey has to read this thing???

    Key Question: AFAIK, None of us who ate dinner at the WB knows who paid for the check. We were told that the check was taken care of and we had to leave immediately through the back door under escort. I saw the waitress and she looked troubled, as if she might lose her 18-20% gratuity that she receives for serving large parties.

    Smurf, Graham, BF, Glibby, and everyone else: Who paid for the check? I had cash ready to pay for Swift Jr and myself + WBM birthday contribution and was told by the security man that the check was paid. Did WB comp the meal or did CoS pay the check on the condition that we were 86'd?

    IMO, Westin should have simply refused us to allow us to have dinner on its property as is its right. WB instead allowed us to have a meal that was unexpectedly terminated by WB security.

    This was an episode in which the critics were not in a tenable situation. We were on private property and hotel security was threatening to arrest us if we did not leave immediately after dinner. The larger legal problem for Westin is that it allowed us to pass into the hotel to have dinner. As such, we as guests had a reasonable expectation that we could have stayed to have coffee and desert. Instead, the hotel demanded that we leave or face arrest for, presumably, trespassing.

    There now appears to be a pattern of "trouble at dinner" when OSA knows where you are dining after a protest:

    1. We had a rock shatter a window at a dinner following a protest. Photo of the window is online.

    2. We had "Crazy Guy" screaming at me and then screaming at Tory at another dinner. WBM video is up.

    3. Now we have WB security throwing us out.

    There is clearly a modest civil lawsuit for us here if we want to pursue it. Specifically, I would like to get Scientology and WB officials on the stand to see what they did or said to eject us from the hotel. By implied contact, Westin accepted our business when we were allowed in for dinner. By then ejecting us from the property -- and we had not misbehaved in any way whatsoever -- I allege that Westin/CoS conspired to deny we critics equal rights and equal protection under the law.

    This is not over by a damn sight. We had to make a tactical retreat under the coercive threat of arrest by hotel officials that, I allege, were acting at the behest of CoS. IMO, CoS officials may have threatened to not do any large events with WB in the future if we were not ejected. IMO, there was some stratagem or gambit on CoS' part to induce, or otherwise pressure, the WB to eject us.

    I don't know about this assertion, they can refuse service if they want to. There is no guaranteed right to coffee and dessert. Possible reasons they could give is that they were getting compaints for guests, someone was filming on private property after being asked not to, the overall distraction of having you in the restaurant was too much. Also someone can just claim you violated the agreement or someone told the manager you did and it was a staff miscommunication that precipitated this. (Insert not-quite-so-apt analogy about a person misbehaving at a bar or coffee shop and being asked to leave for disturbing other guests, etc.)

    Equal rights & equal protection? What civil rights are involved here?

    You don't think a judge is going to laugh this out of court with the full detail and video footage from Westin and security (and who knows what kind of scilon surveillance? This claim of a civil lawsuit over coffee and dessert???

    I thought you opposed the cults used of meaningless litigation? Also, weren't you all sitting at dinner laughing and feeling smug over the enturbulated scilons pacing back and forth in front of the restaurant??

    Lothar, were you there? If not, perhaps you are pre-judging in the abstract? I haven't spoken with an attorney yet. This may amount to nothing as you suggest. Conversely, a judge might see this as part of a larger Free Speech issue. I take your points, but let's agree to disagree until more research is done. I am not interested in money here. IMO, there is a larger issue: The Cult has no right to dictate to its critics where they may or may not eat, particularly where said Cult does not own or control the property in question.

    Clearly I agree there could be / should be a RICO filed because of the intrastate nature of the abuses of the Sea Org employees / CSI, especially with abuses by corporate CoS in LA, Nashville, Gold Base over quite a few years. I fear though the harassment of critics may be hard to prove because of evidence (like shattered window by rock, etc.)... The only thing I've seen with any RICO worthyness is this trend now docuemented of CoS staff directing security and police to harass (possibly with intent to violate civil rights)... This is Gold Base, Nashville, and possibly the Westin now.

    But this has nothing to do with the actions of Westin or the abrupt nature of dinner. I still can't see mentioning civil action against Westin.. especially because PRIOR to Graham Berry post, you wrote this 1 day ago...
    Was the caek before or after escorts came??

    "Everyone knows....". And your proof of this is??? I know Moxon and how he ticks. I worked for him. He would impale himself on a sword before picking up a dinner tab that included meals for me, Mark Bunker & Graham.

    I was told that a female member of our group paid for the meal. I thanked her & hugged her for it and she responded with, "You're welcome." That settles it.

    I can understand Scientology's total contempt over our being allowed to eat within the Westin. They had an agenda & felt totally violated that the demonic critics of the cult entered their temporary holy sanctum when they could have easily dined elsewhere away from the Westin. We pwned them and they knew it but certainly were not happy about it.

    With Graham's letter and any other complaints filed with the Westin, you can bet that Scientology will respond accordingly (especially after OSA trolls read this this thread) with the same mass letter-writing campaign that Catherine Fraser & OSA coordinated to promote Jeff Stone's anti-protest ordinance.

    I suspect Westin's position is that they stand by their paid customers, regardless of who they are. They are not going to be interested in what others think of Scientology.

    Who says? There were some crazed Scientologists out front screaming threats (trying to look like hotel security), but the Westin staff didn't. In fact, RIF and I talked to a delightful *actual* Westin guard/doorman (the real guys had real Westin badges), who said, "Sure, you can have dinner here."

    I said, "Ok, but we're protesters. We're standing across the street with signs."

    And he said, "No problem."

    Then he proceded to tell us where the brewery was, and how to get up the elevator.

    As soon as we walked in, the crazed Scientologists went off on us, but RIF just told him to calm down.

    The Director of Security for the Westin told his staff that if I stepped on the sidewalk in front of the hotel to arrest me for trespassing.

    If you post stuff here you got to expect comments - I assume that's why you do it.

    IMHO its an awful letter Graham. Westin will probably respond politely with a few free vouchers and pin it on the crank complaints notice board.

    As for us "keyboard [STRIKE]warriors[/STRIKE] warriers" just how was it going for you before anonymous?

    I had been in the hotel a few times, to buy something to drink and to look around. One of the Scientology security people followed me around and alerted security to my presence. I had trouble finding the street exit door in the building but when I did a Westin security guard barred me from leaving insisting to see my camera and the photos on it. I told him I simply wanted to leave, that I was not looking for trouble and I refused to show him my camera. I manged to go around him and he followed me out and told me never to come back.

    I then waited on the sidewalk; I was surprised at how rude and aggressive the Westin security staff had been. Then the director of security came out and told me the sidewalk was private property and that I was trespassing. I doubted the validity of his claim but I stepped into the street. He told his staff if I stepped on the sidewalk to arrest me for trespassing. The director also insisted to see the photos on my camera. I showed him a few and when he saw I had photographed protesters on the bridge over the street, he demanded I delete the photo. I refused at which time he also told me never to come back.

    After the dinner party went up to the Brewery, I waited in the street while the parking attendant summoned security. I asked if I could join my friends at dinner and he said yes and escorted me to the Brewery with a Scientologist following.

    One other critic told me he had gone into to the hotel and they told him to leave and never come back as well.

    I did nothing to disrupt or interfere with the Scientology event while inside the hotel. Still they objected to my presence in the hotel.

    I'd be very interested to hear WB's explanation for hustling paying customers down the back stairs like that. For those too young or too stupid to know... Yes, dining at the restaurant of one's choice is related to civil rights.
    Trying to force Tory down five flights of concrete stairs is an outrage. Denying her access to an elevator when she requested it is lowdown rotten as is lying about the availability of an elevator. If anything is illegal in the whole chain of events, this may be it. It reminds me of the scilons denying access to people trying to use the sidewalks near Sunset, "Bad People".
    If people who were actually involved think it's a matter worthy of pursuit, that's good enough for me.

    When Tory asked to use the elevator at the top of the stairs from the 4th floor deck I heard the Weston security staff agree in a professional tone and as far as I know they did escort her to the elevator and down to the 1st floor exit.

    That's not accurate. In fact, when Tory asked Samuel how many flights of stairs she'd have to walk, Samuel said "five" and I took very loud exception to his abusive conduct.

    Tory took exception to me referring to her as "disabled" for the need to use the elevator versus the stairs.

    Plus, I do not recall you being there at the time, Mark.

    Mr. Berry, I like you. Your dedication to your cause and the help you offer are truly admirable. However, from an outside observer, your actions often seem to be a bit, counterproductive. Such as the letter posted in this thread or your recent actions at AGP's hearing in which you tried to bring in Operation Snow White and then called the prosecutor "corrupt" when she said she didn't care about it. Now that is AGP's account of events so forgive me if that is not how things actually went down.

    Still regardless of that, it seems that sometimes you maybe get too wrapped up in your activism and forget how the rest of the world, who doesn't know scientology like you do, views the CoS. I've noticed that you have been sanctioned in California for filing frivolous lawsuits against the CoS. Of all the suits you've filed or acted on behalf of, how many have been sucessful? People here are just trying to be helpful and make useful suggestions, no reason to get so hostile in your response.

    Again, I really like you and think you're a great guy, but there's no harm in playing the game a little. Take what victories you can from the CoS. Constantly swinging for the fences might not be the best strategy. Then again, I'm not a lawyer, so take that however you wish. Best of luck.
