Of course, if any of them are parents it would deeply shit them. Saying that it's the kids fault is like saying a rape victim is at fault because she wore a short skirt. I daresay any parent in the jury would go "You fucking cold-hearted vile bitch" for even considering that it was the victims fault because she was bad in a past life.

I'd say it would go to the defendants state of mind. Though it could be argued that it shows her attempts to get Carmen to simply go "Well, it was my fault cause I was bad in a past life so I'll be quiet" which would then be perverting the course of justice.

But no, I wouldn't say emotional injury is involved in perverting the course of justice as then you could argue that emotional suffering as a result of any crime is perverting the course of justice. While the actions were in keeping with their practices, this is not the view of the broader community. I don't doubt for a second that this will get brought up.

In fact I know personally someone who sued someone in the past for denying something that was true. The person believed it cost them a job. The judge said that he agreed that the defendant knew they were lying and meant to sabotage this persons chances of getting a job. What happened is that this guy was accused of stealing at work by this manager and fired. The Co did an investigation and found that he did not steal the money. Later on the plaintiff went to look for another job as he did not want his old job back. The company offered for him to come back but he still had to work for that manager I guess they believed the manager made a mistake in good faith. He was not rehired as a result of refusing to come back. This guy applied to another company and explained the situation during the interview. They said it would not be an issue if they could validate what he said was true. They called the old company and the first person they spoke to was the manager that fired him. It went something like this as I recall. (Was XXX fired?, YES. He said he was fired then found to be innocent is that true?, NO. He sounds very convincing on this?, He would but I refute totally that he was innocent.) Now maybe the manager still believed he was right, who knows but this guy believed he it was intentional. As I said it was enough for him to sue the guy for costing him the job and the judge totally agreed with him. The issue he had is when it came to damages. The judge said because no salary had ever been agreed too during the interview and that there was no guarantee how long he would have worked there or that they had mad him a firm offer he could not prove specific damages. He gave the guy court coast and lectured the manager bla bla bla.

How do you show a reputational injury? Well, either the statement is so obviously defamatory (e.g., false accusation of a sexual disease; i.e., per se defamation), or you find and present witnesses who, perhaps, declined to hire you based on the alleged defamatory statement, or who had you removed from your school board. I am not nor have I eluded to proper legal precedent for winning a case but filing a charge. What I am talking about is a Prima Fecia case to make the charge. It is up to the plaintiff to prove their case in court. 100% of the time there will be a party that thinks it is unfair what the judge decides because someone will loose. I never said that they could or would win a case. What I said is if they can successfully argue that the comments that Jan and the COS said were knowingly false, intentionally harmful and caused damages they have a case. This is not some mystic cryptic thing in law that is beyond the understanding of they lay person. As from the wrong jurisdiction I corrected myself on that and at that point I was taking about the criminal side not this topic of civil law. All the same this debate is derailing the thread and I don't want to detract from the fact that Jan is getting hers. Anyone can feel free to continue to tell me I am wrong on this topic and that is fine but with the arguments currently made just except that I will never agree to it.

The incident happened how long ago? I don't know Aussie law but if that had occurred in the U.S., Eastgate would not have been arrested in the first place due to the statute of limitations. I suspect Eastgate will agree to a plea deal of some sort with the agreement with the prosecutor to keep the details confidential.

After this I began to see too many inconsistencies between theory and practice (times of more than 11 hours a day, 6 or 7 days a week, miserable payments that were 100 to 20 pesos a week, and the way how they influencing children to keep them away from their families, supplying the parental authority of the hierarchy of that group.) In the same year -1998 - my youngest daughter -13 years old-(name I prefer to maintain anonymity) for ODD needs, pressed to accept a "scholarship" to study at the Mecca of Scientology known as Flag "in Clearwater Florida USA, under the same cost of ODD, this was accepted by me at the time as a legal guardian.

My daughter was in the United States from 1998 to 2000 during which time I had to be sending $ 500 a month so it could cover its costs, in addition to paying your fare ", the first problem I had was that the legal guardian appointed to my daughter abroad, he returned to Mexico without her. By requesting that organization the immediate return of my daughter, was denied by Hector Cruzado, any person holding an executive position in ODD, the denial was for almost 2 years, making it back to 2000 when I mentioned that I was going to make a complaint kidnapping with the Attorney General and illegal residence with a minor Foreign Affairs should be added also the fact my daughter was admitted to the U.S. with a tourist visa for 6 months, and was never renewed during the 2 years that my daughter was under the "protection and care" of Scientology in USA, so that after the expiration of his visa as a tourist, my daughter's stay in USA was considered illegal, and this influences their personal history in this country, and this practice is carried out in most of a Foreign staff in USA which is "scholarship"

When my daughter returned to Mexico, while I was in a difficult marital situation, which later ended in separation (caused by another member "prominent" of the association of Jorge Pedroza on how committed adultery with my then wife, in collusion with executives of ODD), my daughter informed in writing before she go to the United States, having at that time only 13 years old, was sexually harassed and abused by Mr. Alejandro Aristi Guerrero (adult over 30) and employee of the Organization Development and Dianetics, AC occupying an executive and certified with a high level in therapies and courses run by this group and that "guarantee" that such therapies and courses people become more ethical and honest, this case shows that such courses and therapies are only fraud.

My daughter decided to report it because the aforesaid individual, he was demanding sex under siege continued taking it for this then 16 years. Due to the internal policies of Scientology of which prevents a claim to another Scientologist Scientologist, in charge of legal affairs in ODD, named Margarita Ibáñez, I coerced under threat of expulsion and to receive the maximum penalty of Scientology on me, not go with the Mexican authorities and establish a criminal complaint. This act goes unpunished so far and the perpetrator is under the protection of the Mexican Federation of Dianetics, AC as its only justice draft amendments and included only 300 hours of community work within the same Association and repay all their courses and to make a substantial donation to the International Association of Scientologists, these "donations" were made and was reinstated for people to keep flowing lines of Scientology, without paying the crime of "sexual abuse of minors" and also should add that after making the complaints I heard this guy (Alexander Aristi) and had a long history this type of criminal conduct and had been reported to his superiors several times, coming away with each of them

That is aiding and abetting, it is clear that Scientology does not deliver what it offers in their advertising fails to improve families but rather, remain protected people who commit criminal acts such as child abuse, infidelity, stolen, destroyed, families separated and castrate the future of children forever.

An open letter to any group that deals with child abuse and or child sex abuse. This letter is to inform you about a well documented history of abuse against children in the Church of Scientology and the growing number of victims now speaking out. Currently a major Scientology figure by the name of Jan Eastgate was arrested in Australia for helping to cover up a sex abuse case of a child in the 1980’s. To make matters worse Jan heads a Scientology front group called Citizens Commission on Human Rights. She claims to be an advocate for human rights while the main goal of the CCRH is to eradicate all Psychiatry on earth. Being that victims of abuse often need intense the help of that field it is particularly egregious she was directly involved. Sadly Jan is not alone in her cover-ups of child abuse at the hands of Scientology. I am listing links to reports and first hand accounts of abuse below. It should also be pointed out that Scientology is particularly prone to child abuse as their founder stated in effect adults in little bodies. They are often given adult responsibilities and help accountable as adults.
