    By "drug history' that could mean any medicine taken that was prescribed or otherwise, even those taken as a child. Anyone who took more than an aspirin had to do the Scientology or Dianetics Drug Rundown. Any should have qualified why in her book.

    Nothing says she didn't. We haven't read the book. The lawyer letter sounds like posturing. If Amy is using the scilon definition of 'drug history', them poor pouting Tommy won't have a leg to stand on.

    "... I have urged Mr. Cruise not to give your book publicity by filing a lawsuit while it is initially on sale, but to wait until later..."

    I hope Amy becomes a household name and that many start to ask'Who is this Mrs. David Miscavige? Where is this Mrs. David Miscavige?'

    And if there is a lawsuit against the book, would the cited Mrs. David Miscavige have to attend the legal proceedings? Would Tom Cruise do that to his best man? Dig up skeletons from the closet (so to speak) and have Mrs. David Miscavige attend a trial?

    Go Amy Go! I think you have many supporters that want to see this played out.
    And fuck Tom Cruise and David Miscavige.

    Its actually smart for them to bring this out now. If TC tries to block this too much then they have strong case to say well just ask Shelly. And we all know how easy it is to talk to her.

    Good grief, they even recognize their fail in advance, come to a reasonable conclusion that being a whiny sue-baby will only benefit Amy (yes, Streisand Effect, exactly!), and EVEN SO, they can't prevent themselves from failing anyway.

    I think this needs to be spread far and wide. Would be pretty amusing if people came out of the woodwork to share pix of themselves sharing a blunt with TC, etc.

    After all the noise about suing Andrew Morton over his bio of Tom Cruise, there was no action except for baaawing and threats to easily scared publishers. (Possibly because the bio said that Tom was a flaming heterosexual.)

    Dear Ms. Scobee:


    I represent Tom Cruise I understand that you plan to publish a book that includes assertions about Mr. Cruise that are demonstrably false and defamatory.

    For example, your book claims that Mrs. David Miscavige said that Mr. Cruise had a "drug history." This is false. Mr. Cruise has no "drug history" whatsoever. He has never used illegal drugs of any kind. On the contrary, he has extremely strong anti-drug views. Your publishing the assertion that he has a drug history" would be not only false and defamatory, but highly damaging both personally and professionally.

    I doubt that Mrs Miscavige ever said any such thing; but, even if she had, your repeating that false and defamatory assertion by attributing it to her would still be libelous.

    Another example is the assertion that Mr. Cruise was given an ultimatum to choose between Scientology and Nicole Kidman. That too is false. He was given no such ultimatum. Nothing like that occurred; and Scientology had nothing to do with Mr. Cruise's divorce from Ms. Kidman.

    Next, I understand that your book asserts that a Scientologist handling Mr. Cruise's finances was punished for losing him money. That never happened either. For decades, Mr. Cruise's finances have been handled by professional money managers, who are not Scientologists. Their performance is overseen by a Financial Board. Its members are also not Scientologists. No Scientologist has ever been assigned to handle any phase of Mr. Cruise's finances or has ever done so. I have represented Mr. Cruise for many years and have never once discussed any aspect of his financial affairs with any Scientologist.

    I also understand that your book asserts that Mr. Cruise's household staff is selected by Scientology and is paid money by Scientology. This is also false. Scientology does not select his household staff, and they do not receive money from Scientology.

    While I am advised that your book contains these false and defamatory assertions, I have not read it. It may contain other claims that are also false and defamatory. The claims I have delineated certainly are.

    Assuming that you publish these libelous assertions, I have urged Mr. Cruise not to give your book publicity by filing a lawsuit while it is initially on sale, but to wait until later to file an appropriate action for damages.

    Naturally, all of his rights and remedies are reserved

    This is the kind of thing that Fields will use to frighten off the likes of Amazon in the UK from selling the book. Such mere threats worked to prevent whole UK publishing company from releasing Andrew Morton's Tom Cruise Biography in the UK.

    Lol, like that shit ever stopped the spread in the news media of the exact information which the Cruise/Fields/Miscavige camp wanted to block from being published in the first place. (and more so when the author gets on the TV to talk about the controversy).

    Someone needs to wordclear "libel." If it is true, it isn't libel.

    Just read an interesting parallel.

    I am guessing that Amy could argue that she, in fact, reported what she believed to be true, from a reputable source. That, too, is probably not libel. The intent was not to defame, but to relate what she was told and, thus, believed.

    It will be interesting if this manages to go further. A bunch of "she said that she said that he said", you know? Good luck proving it was or was not SAID, regardless of whether or not it can be proven to be false (or true).

    Also cute is the lawyer's comment that he has not even read the offending statements (nor, indeed, any part of Amy's book). He is, thus, waving his legalp33n around on behalf of Tiny Cruise based on RUMOUR about what the book MIGHT mention.

    How much does he earn an hour? I think I could get sufficiently outraged on a celebrity's behalf over every single allegation, rumour and blind item s/he gets butthurt about and write a stern "Now, cut that out immediately, you naughty person" letter, provided it paid well enough (I'll take HALF what he makes an hour! BARGAIN!) and they didn't require an actual law degree. LOL.

    At least they could wait to see if the rumoured content alleged to exist in Scobee's only-just-now-about-to-be-available book is actually there, and actually something they want to whine about.

    Before Bertram Fields accuses someone as being libelous & slanderous, perhaps he should clear up his own issues of being racist & anti-Semitic, with regards to comments me made about Jewish addiction counselor Drew Pinsky.

    "In June 2008, Dr. Drew Pinsky, in an interview for Playboy, mentioned his belief that for Tom Cruise to be "drawn into a cultish kind of environment like Scientology," he was likely to have emotional problems. He said "To me, that’s a function of a very deep emptiness and suggests serious neglect in childhood — maybe some abuse, but mostly neglect."

    Fields, representing Cruise, responded by calling Pinsky an "unqualified television performer" and likened him to Nazi Joseph Goebbels, saying "He seems to be spewing the absurdity that all Scientologists are mentally ill. The last time we heard garbage like this was from Joseph Goebbels."

    Pinsky, a licensed physician of Jewish ancestry, responded through his representative, "Dr. Drew meant no harm to Mr. Cruise and apologizes if his comments were hurtful." The statement continued, "Although Mr. Fields's intent is clearly to slander and discredit Dr. Drew, under no circumstances is Dr. Drew making a blanket diagnosis about Scientology nor Mr. Cruise whom he does not know.     While asserting that what a third party says is true may in some limited circumstances be prima facie libellous, simply reporting what the third party says without such assertion fails at the first hurdle. Accordingly, fuck up and die.
