Yes, that's exactly what she did. Then they sacked one of the main whistleblowers, but let her resign and keep her stock options.

The actual arbitration judgment is here: Seth Joseph v Digital Lightwave Court Documents - Arbitration Award . At page 6, the arbitrator made a finding of fact:

Hey, they're the most ethical people on the planet.
    And don't you forget it.
Nixon was not a crook, and OJ's gonna find the real killers.

Great response. I'll take that as, "He did a great job and I would know one when I see it. And here's examples of how he did a great job:....."

Thanks, Tiny, for the links. Great reading.

And I loved this story I found while reading something else:
Tampabay: The CEO and his church

Hey Marty! Tell us about this one!

And to Tommy Davis, no disconnection, eh?

Prefer not to dox myself, but thanks for asking.
    Read the thread,
The comments of others, not just me. (I thought MrNiceNice put it quite succinctly and poetically.)
You've made your points: You can vouch for the total honesty of all...how many was that? (I checked)....officers on the CPD (do they have an internal affairs department, and why or why not?), and you can attest to their outstanding investigative skills, despite what others have pointed out here.
    I get it.
Lets us both just pretend there are ignore buttons, at least on this issue.
And lets let these other anons do what they do best.
They seem to be doing a damn fine job.
Maybe you can read the dox and contribute.
I'd love to hear your analysis of specifics.
    Seriously.

Holy shit, did you read the Steve Grant testimony and Denise's emails ?

Got to read these dox. it reveals something about Jerry and Denise Gentile : )

Yeah Jerry Gentile worked at Digital Lightwave too, when Denise was Denise Licciardi.

Like I said, truth is stranger then fiction.

Jerry Gentile was in on this mess too.

We got dox, it's not gossip : )~

Re: Clearwater PD files on Kyle Brennan's death

Not much chance that they'll ever be deposed in this case.
    Further review of records:
Tom Brennan burned down his business to conceal his embezzlement.
Pressured his son to take the "personality test" and go to NarCONon.
Lied to Kyle on a previous visit about having a place to stay for him.
Kyle had to stay with $cientologists, which made him feel very uncomfortable.
(BTW there were 5 bullets in his pocket...I think I said 4 previously).
Kyle had huge argument with $cio-daddy and told him only an idiot would believe in lrh. $cio-daddy told him his mother was evil and trying to harm him with psychiatry and drugs.
Kyle overheard dad and wife talking about how Kyle would be declared an enemy of the "church".
That night Kyle awoke to see daddy holding a large object over him.
Kyle began stacking items in front of his bedroom door to block it.

Dad lied to Kyle (on previous visit) about motives for getting Kyle to come there.
After that visit Kyle and mom began receiving $cio literature about the evils of psychiatry.
Daddy had found writing of Kyle's about Kyle's knowledge of daddy's arson.
The day after the death daddy answered the phone in an upbeat jovial way "Hey Scott, what's new man?" until he realized it wasn't "Scott".
Daddy told mom that he hadn't pushed $cio on Kyle, and that it was over and they needed to move on.
Daddy said that day that he suggested that they go to the fair, but Kyle didn't want to go.
(This is a reference to the fairgrounds where daddy was hawking $cio crap although he attempted to mischaracterize the purpose of going there.)

Kyle was fearful of running out of his medication, was conserving it, and taking it only when he thought he needed it most.
Kyle's bags were packed when he was found.
Daddy first said the ammo was in a seperate location, later said it was in the same nightstand.
Bohling only talked to Tom Brennan twice, 2-17-07 and 2-06-07.
(A repeat: if the stopping meds was a "mutual" decision, why lock them in the truck? In case Kyle "unilaterally" changed his mind?)
Remember Denise Miscavige is at all times advising daddy, i.e. NarCONon, etc.
Daddy said he called "his CHAPLAIN Denise".
Jerry Gentile later denied that Denise is a chaplain, and claimed not to even know what that means.
Tom Brennan says Gentile was there when the cops arrived. Gentile says the opposite.
Bohling either didn't notice the discrepancy, or chose to ignore it. Same with "chaplain" and who Brennan requested come over, Denise or Jerry.

Bohling only talked to Brennan twice. Notably, NOT after he had received a great deal of further information from the Gentiles, Kyle's mom, brother, and the computer.
Case closed, nothing to see here.

In Bohling's defense, this probably was what it appears to be, a suicide. All of the gross negligence which may have caused or contributed to it is not necessarily relevent to a criminal investigation.
You all have a far greater knowledge, presumably, of $cientology, computers, and the like, than the average person, or homicide detective.
We for example are aware of lrh statements about being able to induce people to kill themselves.

"Act like a dumbshit and they'll treat you as an equal"--J.R. "Bob" Dobbs
BTW, that's not a summary of all the records, just the last couple I read.
And, since the newspapaper and Co$ referred to "200" pages, I'd love to see the rest. (I'll go back and count maybe there are 200 in what was posted here)

And for the record, reading autopsy reports is never fun.
  15. Re: Clearwater PD files on Kyle Brennan's death

I second the suggestion that 'sub' be dropped from 'Subgenius.' You've assembled a clear-eyed, easy to read summation of the facts and we're grateful for your inciteful work.
I'd like to call everyone's attention to the various $cien. course completions Denise accomplished shortly after Kyle Brennan's demise. (Google <Denise Gentile, Scientology Completions>) I hope Kyle's mother's lawyer is monitoring these pages. Many eyes make for easier work.

Re: Clearwater PD files on Kyle Brennan's death

Luke Lirot adequately noted a number of ways the police investigation was perfunctory at best and abjectly subpar at worst.

    1) They simply accepted an abjectly insufficient explanation as to why Tom Brennan's response to finding his son gravely injured and probably dead was not to call 911 immediately, but instead to call Scientology.

    2) They apparently didn't even know about the existence of Kyle's laptop before his mother called them. They did not call her. She called them. They don't even contact his next of kin in his state of residence?

    3) Once Gentile arrives, do they immediately dial 911? Apparently not. Apparently they went around destroying evidence instead.

    4) Assuming these files are the entire results of the investigation, they don't appear to have put together a coherent timeline at all as to who did what, and accepted patently absurd explanations as to why this was the case.

    5) Despite Gentile and Miscavige blatantly avoiding the police and only showing up for a brief interview after all kinds of suspicious dodging, they then, again, accepted patently absurd explanations of why Jerry Gentile was deleting files off Kyle's laptop after he was dead. He actually expects us to believe his six year old daughter is responsible? This is patently ridiculous and cried out for more investigation. One can only assume willful blindness. The cops had decided on their explanation and were going to stick to it, come hell or high water.

    6) Did not follow protocols under 406.11 section IV under "traumatic or suspicious death." More on this to come.

    7) Why was the home address listed as Tampa, Florida, when all of Kyle's identification clearly indicated he was a Virginia resident? That, incidentally, is where his estate, administered by his mother, is located, and is the basis for diversity jurisdiction, i.e. why the case is in federal court. This shows extremely sloppy investigation.

    8) Kyle was listed as a "missing person" in Albemarle County. Why did the Clearwater Police Department fail to contact the Albemarle County cops?

    9) Where was the weapon even kept? Where were the bullets kept? Why was Tom allowed to give inconsistent explanations of this, such as that it was on a nightstand, or that it was in a bag? Why was his claim that he didn't even know where the bullets were accepted at face value?

    10) Why was this presumptively treated as a suicide despite the lack of a suicide note and the fact that the primary witnesses in the case were clearly being deceptive with the police, clearly destroyed evidence, and otherwise acted suspiciously throughout the entire investigation?

    11) Did they even analyze the handwriting on the note on Kyle's body saying "look in pocket?" Did they try comparing it to a sample of Kyle's actual handwriting? There's no indication in the file they did any such thing.

    12) Kyle placed heavy water bottles in front of his door when he was sleeping at night and on the night of his alleged suicide, directly in front of the apartment door. He made three phone calls immediately before his death. Why weren't the people he called contacted?

    13) Tom Brennan stated to a family member that he'd had a wonderful day with Kyle the day of his death, and in fact, that they'd eaten a large meal in Kyle's favorite restaurant. Yet, the autopsy says there was no food in his system. Why was this taken at face value?

    14) Again, two hours after his death, a Scientologist was deleting files on his laptop. How could this not set off alarm bells?

    15) Did the CWPD make any remotely competent attempts to restore this data? Having looked at real computer forensics work in the past, what the CWPD's "expert" produced in this case is pitiable garbage and does not demonstrate anything remotely like a serious attempt to recover data. Pretty much anything deleted immediately after his death would be at the top of his list. A ridiculous search for four keywords pulled out of a hat is not tailored to discover real evidence.

    16) Again, all the witnesses in this case blatantly and repeatedly lied. Why didn't this create a suspicion in the minds of the CWPD?

inb4 612 spazzes out and takes any criticism of the CWPD as a personal affront.

Why is the computer reported as Evidence/Seized on 02/17/07 [see page 10 of the report], although the police didn't have it at that time?

Re: Clearwater PD files on Kyle Brennan's death

Not just training completions, but some auditing completions. She completed two sets of "False Purpose Rundown Auditing" aka "FPRD".

There's some written up about FPRD on wikileaks here: Talk:Scientology False Purpose Rundown course - Wikileaks

Scientologists believe that you "pull in" crap when you have "overts" (have committed sins; done bad or evil things) and they believe that if you run FPRD or "get your overts off in session" that magical things can happen. In this case, it's possible that Denise Gentile was put in session to find her "overts" and "get off the charge on her case" so that any investigations would go away and she wouldn't "pull in" legal crap.

Of course, the scio-tech doesn't work magically that way (they just think it does) and she has "pulled in" this lawsuit two years after the offenses.

Oh damn. Thank you for pointing that out. I forgot there were still two documents in there I hadn't read yet! :/
  28. Re: Clearwater PD files on Kyle Brennan's death

Well, my hillbilly foreman used to say: Who's smarter, the genius, or the guy who hired the genius? j/k - I don't know any foremen, but I do know a hillbilly ...and I did stay at a holiday inn express last night.

Don't know if this is relevant, but it may be something to consider. I was talking to a pharmacist about Lexapro. He said sometimes if someone is taking a 20mg dose, it can be less expensive to get the 40mg and split them.
So, it's possible Kyle could have had a full month's dose with those 16 pills.
Again, prolly not relevant, I just thought it was interesting.

Re: Clearwater PD files on Kyle Brennan's death

On that count I think you were being hairsplitty. She said "I am sick of the fucking CWPD enabling Scientology in that town!" It's a casual reference, along the lines of "Chicago is my kind of town."

Re: Clearwater PD files on Kyle Brennan's death

As a matter of Florida state law, Clearwater is a city, which is more a matter of the form of local government than size.

Re: Clearwater PD files on Kyle Brennan's death

So how do they know files were deleted? Were they properly deleted (e.g. using Eraser), or shabbily deleted in the normal windows way (i.e. can recover some contents with a free bit of software)?

    BRb reading d0x.

Re: Clearwater PD files on Kyle Brennan's death

Ok, from forensics docs it seems that a folder called bigfix was deleted after or around his death.
This folder may or may not have had something to do with this software:

bigfix.exe Windows process - What is it?

It's security software. It can used to monitor a user's computer, from what I can see on the page above. I.e. it could be used to spy on someone. Not getting all tinfoily here, just mentioning possibilities.

And also, to answer my own question: it was the crap sort of delete, that can be detected. (Either that, or it wasn't even emptied from the recycle bin?)

Re: Clearwater PD files on Kyle Brennan's death

    Question for medfags and pharmafags:

Bohling cited often in his notes the fact that Kyle's doctor said that if he went off Lexapro suddenly there wouldn't be any side effects (or nothing much).

"Side effects" is a term of art in medicine as far as I recall and doesn't include all the effects that a medication might have on a person.

How reasonable is it to think that the doctor being asked specifically about side effects might not have mentioned the natural changes that a sudden removal of the medication might being about?

Re: Clearwater PD files on Kyle Brennan's death

"Det. Bohlen: And unfortunately, when this all happened with Kyle, it hit the news. It hits the internet. These things go on and on. You know i don't have to tell you.
    L. Fugate: Oh Yeah. The internet's just unbelievable.
    Det. Bohlen: Yeah.
    L. Fugate: Unbelievable. "
    How cozy.
Yeah don't read the internet, its bad.
fugate btw was cos' lawyer in lisa mcpherson and here was his scientology remedy for what happened to lisa:
"Fugate disclosed that the case has prompted the church to arrange for a licensed doctor to be on call at the church's facilities in downtown Clearwater. He also said local hospitals, including Morton Plant Hospital in Clearwater, have agreed to keep Scientologists with psychotic symptoms out of their psychiatric wards."
Yeah that should help. Deny treatment to people even $cientology considers psychotic.

And notice at the beginning of the Denise interview (p. 65) how Fugate attempts to buddy up to and sway Bohling:
    Fugate: You know Don Horrox?
Bohling: Yeah that's a familiar name.
Fugate: He's a judge over here now. Don was going, "You know Lee...."
(Hey Bohling me and this judge are on a first name basis)
    Bullshit.
