Clearwater PD files on Kyle Brennan's death

    First the computer forensical report states that "there was no evidence that any files had been deleted" [page 28 of "page one includes statements.pdf].

    Then Gerry tells some story in his interrogation, that he tried to copy some files from the laptop to a thumb drive, converted the files and then accidentally copied the converted files back onto the laptop and erased them after seeing his mistake. [page 46 of "page one includes statements.pdf"]

    1. Then why didn't the forensical report found evidence of any erased files?
    2. Why did he even put the thumb drive back into the laptop, after he had copied the files on his computer and converted them there?
    3. How could it happen that he "accidentally" copied the files from there back to the laptop?

    Also the forensical report states, that the "Suspicious Activity" file/folder had somehow been accessed by "Bigfile.exe" and could therefore not longer be accessed for review.
    ?
    bigfix.exe - Bigfix, Delete and Removal Information!
    How could this "BigFix.exe" tool possibly make a file inaccessible for a computer expert?

    I guess when I review the records I'll find out why he said he was copying files from someone else's computer after a traumatic death....probably not huh?
    Boy, Tom Brennan "lawyered up" pretty quickly, no?

    Hey. I said I WONDERED about it. You would load all the chambers? Fine. I'm not reeling with ZOMG!1! astonishment over that. I just found the extra bullets curious, for fuck's sake. I haven't ever tried to shoot myself in the head, but I think if I were going to, I would just load one bullet. I know many people survive gunshot wounds to the head, but I also know most of them are severely injured or at least rendered unconscious or otherwise incapacitated. I wouldn't expect to have a chance for a second shot.

    So to me, it seemed odd. Like I said, it made me wonder. But it's not like I'm convinced someone else has to have loaded the gun.



    I'm not convinced any fingerprints were wiped off of anything, though I guess it's possible.

    And 4 in his shirt pocket.
    And dad said at one point the bullets were kept elsewhere, and at another point says they were in the same nightstand as the gun.

    Again, it's not like TV. It's tough to get usable prints off of a bullet. Besides, what would prints prove?

    I wondered about these things too. Not that I know so much about computers, but from what I've read about computer forensics, it seems to me that if files were "erased" and their expert didn't find evidence of it, the expert was not very good. Similarly, I knew nothing about Bigfile.exe, but I wondered if it was really impossible for the "expert" to access that file.

    The absence of prints anywhere would suggest that the bullets and gun had been wiped down and cleaned.






    However the police report said that they couldn't find any usable ridge detail. The report did not say that there were no prints on the bullets or gun. That's fairly common.

    So hours after Kyle's death David Miscaviage's brother-in-law is looking through Kyle's computer files. And David Miscaviage's sister is on the scene saying it doesn't look too bad. And David Miscaviage's niece is cleaning up the mess.

    Nothing to see here folks, move along.

    I remember a crime scene (real life; not TV) where there were beer cans left behind. The cops wouldn't even take in the beer cans for finger printing. Mumbled something about that being hard or something.

    I was left with the impression that fingerprint lifting and identification was expensive (lab work stuff) and wasn't something they would do and spend money on unless they really needed it. In the above case, the crime was too minor for the expense.

    In the case of Kyle Brennan, perhaps it was just too clear the guy shot himself, so the cops think why should they send the gun to the lab for fingerprints.

    Just sayin'.

    Why was bigfix even used if he just copied the files and put them back?
    Jerry first says he erased the files, and Bohling corrects him and says he didn't erase the files, he just deleted them, right Jerry?
    There is so much nothing to see move along just in the first document. I can't wait not to see anything and move along through the rest of them.
    Oh, Jerry worked for "JDSU", but he didn't know what that stands for. That happens all the time.

    And Kyle's stepmother Wendy was just an aquaintance, then Davey's twin remembered she was the one who introduced them, and Tom, she barely knew, according to Jerry, but Denise says she and Tom are "best friends"
    I was trying to keep track of all the contradictions in the report, I got to about twenty eleventy and quit

    Jerry didn't know who Tom's friends in Clearwater were because Tom's not from Clearwater.
    Jerry asks if the police have gone through the computer and whether they have any concerns about it.
    He protests so much that he's not trying to avoid the police, that even Bohling comments on it.
    Oh, the police didn't even know about the computer until Kyle's brother brought it to their attention from Virginia.
    Any one, two or twenty of these things could mean nothing. After a point, coincidence becomes mathematically impossible.
    Twenty eleventy times alot.
    Its very easy to sit back and shoot down individual bits. Even without reading any of the reports. Very easy.
    There's nothing to see here, just a bunch of anons doing what they do best. Move along.

    Forensic computer "expert" searched for keywords given to her by Bohling; Kyle, dad, suicide, police.

    Kyle's iPod was returned erased.
    Lirot (mom's lawyer) wrote Bohling on 7/1/08 and hadn't heard back on 8/12/08.
    It appears that Bohling's "interrogation" of the Gentiles was only to get answers for the questions the family raised. Nothing that he, or anyone in CPD had thought to investigate.
    And most of the good ones weren't asked or answered, including the really stupid ones like "if he was concerned about his fragile mental state, why leave a gun and ammunition around," oh and, "if the medication was so dangerous and was locked in the truck, why not the gun too?"
    That one is really stupid.
    Scio-daddy told mom he knew nothing about any medication.
    Bohling was aware that Scio-daddy lied, but he did so because he "felt bad."
    Scio-daddy: we went out and had large meal together. Autopsy: no food in system.
    (By the way ignore the fact that the husband of the sister of the COB of the world's most sinister scam was the one to fuck around with Kyle's computer)
    Was the removal of meds a "mutual decision" per Scio-daddy, or "because they were making Kyle act weird", per Scio-daddy?
    Denise Gentile not a cult official but called Kyle's mom to try and get him into NarCONon.
    Scio-daddy "never tried to push $cientology on Kyle". Promo Scio material for Kyle and mom, seperately was received months after his death.
    Including a letter which said,
    "Hello Victoria, how are things going? How is your family doing? The psych video is intense, isn't it? Please write back and let me know how you and your son are doing. Thanks!"

    I would bet she and Kyle are still getting sales material from them.

    I haven't finished reading it all.. but does anyone ever ask the question.. who did Kyle think was after him. He apparently went to the fbi and said it.. went to his aunts and said "they" were after him..

    but I have seen nothing about whom he said was after him..

    He was schizophrenic, if he was also delusional there may be no way to sort out any real danger he was in from non existent danger in which he perceived himself to be.

    Really a tragic story all around. I hope his mother can find peace. And God willing, if there was wrongdoing, let it be uncovered and punished.

    This sounds exactly like statements I've read from others involved in scientology that are afraid they may be killed and want to let everyone know ahead of time.

    I say that's where I was going with my tinfoil about Teresa and Jeremy.

    Allegedly, Jeremy was doing some kind of investigation on them or something and he and Teresa would often tell their friends they thought they were being followed by "them."

    Okay I have been dieing to say this since I read that he thought his family was trying to kill him I shouldn't be saying this cuz it is the kind of thing that starts rumors...

    What if Kyle's dad was trying to put a wedge between Kyle and his other family who believes that psych meds are good for him... Would it be likely for him to try to "handle" Kyle who might be considered a potential new customer for the cult ?

    1) he wouldn't want his kid on psych drugs
    2) Kyle's mother seems to be at least upper middle class
    3) Dad is working on staff
    4) Scientology has been downstat.
    5) The father would really believe it would help his son.
    6) Dad might even get 10% and he needs to rent out his spare room

    (this tinfoil itches I am going to take it off now)

    This is spot on, and a good insight for LEOs on interview technique.

    Never heard of her before this (not that I recall). Don't know anything about her other than what's in the dox pooks dropped and what I just found online via google. But I'm very interested to dig up info if it helps the mother's case.

    Your logic is cogent. Thank you. We can all go home now.

    That is an EXCELLENT question. Cop didn't understand enough to ask it.

    Also, Gerry accessed the computer on Sunday 18 Feb. Printed etc. Gerry says, "After printing the files out, it was shut down and there was nothing from that point. There was -- it wasn't turned on or -- or anything that I know of" (page one includes statements.pdf p54/84). He left for Maryland on the Monday the 19th.

    Forensics say someone accessed the computer on 21 February (page one includes statements.pdf p81/84). Funeral on the 22nd. Father says he mailed computer to Virginia family on 26 or 27 February and no one "else" (other than Gerry) accessed the computer before it was sent (page one includes statements.pdf p81/84).

    So, who accessed the computer on 21 February?

It is headquartered in Milpitas, California, USA. It was formerly known as JDS Uniphase, prior to a re-branding of its corporate image on September 14, 2005. The legal entity is now called JDS Uniphase Corporation, whereas elsewhere the company always refers to itself as JDSU.
