Hoping Sparrow won't be brow beaten in to settling prior to court; I know that innocent in criminal court does not always equate to getting off from civil action, case in point O J Simpson, because bar for evidence is set lower. One hopes they civil court sees through this action like the criminal one did.

Suspect the civil action will also afford Moxon more latitude for shenanigans to spin the case out.

Pretty sure Moxon and Co will try all sorts of tactics to get Sparrow to agree to some kind of restraining order to keep away from the cult in Washington so they can claim victory. Much as I'd hate to see it happen I would understand if Sparrow did eventually settle.

It is my hope that since he was found not guilty of stalking they will have no grounds for a restraining order. If he isn't stalking and there is no domestic violence what can they claim in civil court is the need for a restraining order?

I agree, I'd understand if Sparrow did get worn down by scilon harassment tactics, but-
I trust in the awesome awesomeness of the SParrow. This is an important battle that could have heavy implications for the future. Success here will be a HUGE nail in the coffin of the DC idle org and set precedent for scilon legal harassment attempts in the future. Sparrow has great big clanking balls and is un-bullbait-able. If anyone can do this right, he's the man.

Honestly don't know how things work in the USA, wouldn't be too sure here either. I do know the two types of court are completely different. The bar for proof is down from beyond reasonable doubt to on balance of probabilities in civil court, at least in the UK. As with O J Simpson the criminal trial found him innocent but the wrongful death suit that followed clobbered him (hahaha). This does not mean that will happen with Sparrow, for one thing a lot of people felt that O J Simpson may well have been guilty and there was a lot of, sadly, circumstantial evidence to back that view up. Not sure if circumstantial evidence counts in civil case and IANAL.

I'd like to think that even in a civil suit people will see this case for what it is, an attempt to stifle free speech using frivolous legal action. No doubt there will be some grandstanding and bawwing by the scilons and much use of video and that SP declare he was given telling him he had to stay away from members of the church of scientology. (we told him he had to leave us alone but he wouldn't, he's guilty - NOT!)

I see there was a motion to stay proceedings until after the criminal trial was that submitted on behalf of Sparrow or by Moxon and co?

As to the restraining order was that part of the civil action, if so I doubt it will be lifted until after that has been resolved.

The OJ case was quite a different animal thankfully and the comparison give me the willies It is imo more of an exception than the rule but IANAL.

I hope that the ACLU folks were around watching the proceedings in response to the civil suit.

I know we really don't know the whole story of what happened in this trial with the ACLU being present at the last case(s) until Sparrow is free to fill us in.
Is it at all possible they would get involved in the second case?
Hopefully they will be present at this last case too at the very least?

  22. I know that, I was just wondering what happened between the ACLU lawyer and Moxon. I believe Sparrow alluded to something happening between them.

My guess is that they were attending in case Sparrow lost, as they would have then taken the appeal. Appeals comprise the majority of the ACLU's work. They could also have been attending because they intend to help on a malicious prosecution claim by Sparrow. They weren't sitting there for no reason at all.
