    I think you're thinking about the first amendment here, which says "congress shall make no law...." etc. That is interpreted to include all the activities funded by congress or connected to it in other ways.

    The constitution does have lots of other rules, against unreasonable search and seizure for example. Tennessee also has a constitution. It might become a constituional argument at some point, since the actions of private citizens could be unconstituional if they are permitted/funded by unconstituonal laws or government action.

    But yes, in this case common law and regular statutory law should be enough to judge this situation.

    Ah, yes. So if the event security policy doesn't cover it, then their general liability insurance will.

    It will be interesting to find out if the Security Firm paid for extra insurance for the entire event or just for the days of the permit.

    At least one of those guards was wearing a shirt saying "police". Seems like you can add a report to your local FBI office to the list of things to consider with the lawyer.

    In any case they had some sort of insurance. Doesn't really make much difference in what Victim44 should do.

    It does complicate things slightly though, because the insurance company could do anything from forcing their client to settle fast, or to just refuse to cover this incident if the guards acted with malice/criminal intent.

    Thinking about it from a different angle. They KNEW that the permit ended on a certain date by virtue of the insurance versus a clerical error regarding the permit, employee didn't get there in time to file for additional days and they didn't know it, etc.

    This is going to sound stupid because I'm getting confused by a second date on the permit, but can someone explain how it came to be determined that the permit was only for the 23rd? You can explain in PM if you don't want it discussed here. It may just be lack of sleep, but I'm not getting how we know for sure the permit was for one day.

    OH SHI-- Cocks, on this one.. The event permit and liability insurance it totally moot. This civil rights violation took place on public property. I can't see how the city indemnity would apply, other then this wouldn't have happened is the event didn't take place, and it wouldn't have happened execpt for CoS intervention and misleading hype told to security guards, and possibly direct instructions.

    I think this is only a problem for the security guards (maybe not even the firm) who acted against training (?).

    Well for one thing the STREET CLOSED notice appeared in the paper / public works website for Friday. And every LOL'd they got the wrong day.. Then checking the permits online it appears that the dates for the sidewalk closing is also only for Friday. So.. is there another permit covering Saturday that just isn't in the system yet??? i dunno.. Since the security firm filed the paperwork, and they probably do a lot of it in the city.. maybe they just called their buddy in the PW dept and said, hey extend the permit.. of course by law they have to pay all the permit fees before permit is approved. Could be worth some public record requests.

    I was watching the video and spotted the car that followed us after the protest. Standing to the left is the old OSA guy that was driving it. THe car had blinking yellowish lights in the windshield, blinkers, tail lights, and rear-view mirror. I did get pictures of the driver, but they're stuck in my broken camera card. (It broke RIGHT after we got the video off. O_O)
