    If you can't get a doctor to look at it, take photographs of the injuries, grab a lawyer, and file charges. Failing that, sue them. This is blatantly excessive force, and thus, a massive footbullet.

    I had the chance of seeing the Nashville police at work. A few years ago I was in Nashville doing some work which required us to shut down a sidewalk for a few hours. As we were going about our business a couple of homeless guys came around our barricade. Two cops came up just as this was going on. The best I can say is that cops went all Rodney King on the two homeless guys so much so that we had to tell the cops to lay off hitting these guys. they had them on the ground kicking them and hitting them with their sticks. Once the cops stopped their beating we got the two homeless guys up and gave them fifty bucks and told them to go get something to eat on us. The cops did not like the fact that we did that and that it set a bad example. We told them that our work wasn't that important that someone should get hurt over it.

    It may be a good thing that it took the cops so long to get there. Who knows how they would have reacted.

    Obviously real lawyers need to be consulted, but I would be curious if this was a citizens arrest or did the officer witness the misdemeanor.

    Just FYI, if the permit covered the area you were at.. regardless of the Sidewalk Closed signage, under T.C.A. ยง 39-14-405, once you were verbally notified, the lack of signage doesn't matter. The verbal notification means you are no longer able to claim it was "open to the public". I wonder if you could have demanded to see a permit.

    If they can argue that a person "remained" then it would be trespass.. However the actions of knocking a person down kind make it hard to stick with beyond a reasonable doubt.

    On the other hand, to weigh against the above "personal communication" which makes it obvious about knowingly... the statue also contains this:
    If all three of those are met or there is reasonable doubt it is not guilty.

    If you feel you would have reacted badly to this, please either stay home or watch some videos online of Wise Beard Man being confronted, as well as some videos of police officers arresting combattive people. You need to be desensitized to this kind of thing to the point where you'll be able to see one of your fellow protesters being assaulted and calmly document what's happening. Offering verbal protests is of course appropriate. As might formally placing the assailant under citizen's arrest yourself - but only after studying the law and applicable precedent.

    Under no circumstances should you use force yourself, except if a clear and present danger to life exists.

    As much as people will disagree, you would lose to this in court. Masks and known anti- "church" group... It would be ugly to defend this because of "would cause fear".

    The officer's refusal to take a report after responding to a 911 call should be reported to the NPD Office of Professional Conduct (or whatever the equivelant is called out there) ASAP.

    This is arguable. After all, it's not the first protest and all protests have been peaceful, etc. Beyond reasonable doubt... But, point taken.

    Speaking of melodramatic, calm down people. Sure it's bullshit that the dude restrained 44, but considering he skipped back to the rest of the group, I doubt that the rentacop went Rodney King on him. I can understand being mad about it, and you should consider charges if this version of events is the whole story, but you don't do anybody any favors by flipping out and raging as though this was some brutal beat down. Chill out, let 44 and his friends decide on the best course of action, and then be supportive.

    I didn't say kidnapped. I said that Security guards had taken him hostage. I said "They have him and they're holding him and he hasn't done anything wrong." I made the 911 call. Yeah, they waited 30 minutes to get out there. Mind you, the marathon was almost over. ALso mind you, I volunteered for the marathon in 2005, and the police aren't as tied up as the fire trucks and ambulances are.

    Also blatantly refused to file a report. I will be calling about this... I have his car number. :)

    These were security guards you say? Unarmed? HELL FUCKING NO THOSE GOD DAMN BITCHES HAD NO AUTHORITY TO PUT THEIR HANDS ON YOU!!!!!!!!! When I went for my security license that was one of the BIGGEST DO NOT DOs they told us about. You can only make a Citizen's arrest IF there is an actual crime being committed. You are there to deter crime. You are to act professional at all times. Meaning, NO SCREAMING at people. Something as minor as Trespassing, you are only to escort people off the premises and call the cops if it is necessary. You are NEVER to put your hands on someone. What company???? Those fuckers aren't going to be doing a ton of business as soon as you get the word from a lawyer.

    Let me check to see if armed guards allowed to do what they did. They are not law enforcement, so they have a LOT more restrictions.

    I would just send the video to Berry. Then ask him again. Making the evidence public may not compromise a civil suit, but if there is to be prosecution then the amount of video available might best be kept secret from CoS and the security guards until the police can interview them.

    I know you didn't say kidnapped. Someone else in the thread said that. Although you saying they took him hostage is also pretty silly. From your story they knocked him to the ground and restrained him. It's a dick move, and if your account of events is complete and accurate, then you've probably got a good case for assault or battery (I can never remember the difference between those two). And you have every right to be angry. I was mainly directing my comments towards everyone else here showing solidarity. Solidarity is great, getting caught up in an emotional shitstorm of hyperbole- not so much. I'm glad to hear that 44 is ok, and I hope that people are held accountable for this. Other than that, keep up the good work.

    That's a good point. As much as I want to see the video, catching the rent-a-cops in a lie before they can see the video record could be useful legally.
