If TL;DR: AO won by default and was lucky to get anything.

Seems fair enough. AO really doesn't deserve anything tho, in the court of public opinion. There's a reason why all of Socal disowned him.

Yeah, we should only masquerade within our own race or ethnic group. I guess that prohibits anyone who's not Anglo-Saxon from wearing a Guy Fawkes mask.

I'm not going to engage in a troll war. If you believe that AO's settlement caused DM to double over convulsing in major asshurt, have at it. Given the issues in AO's case, had he behaved in himself and allowed his counsel to do their jobs, I believe he would have looked forward to a much larger settlement. But, it is what is.

As one of the highly respected anons posted on OCMB (who was present during the assault on AO)...

"I don't consider it a win, as I and others spent time and money on lawyers for depositions. Maybe it cost them money, but they have money to burn on this type of thing. We don't. I feel my time and money was wasted. I am sure I'm not alone."

and AGP.. who's used to freeloading off Graham Berry, responded: "I can see how you would feel that way. Why did you hire you own lawyer and not use Graham Berry? Did they ban him with you like they did once with me? I'm fortunate I see Scientology protesting as a way to make, not lose, money. Yet another way to piss them off."

    http://ocmb.xenu.net/ocmb/viewtopic.php?f=9&t=35810

In other words, AGP has no problem freeloading off Graham & others, costing them time, effort & money, in order to get his own way. What a sick, narcissist windbag.

AGP may live in his own world. More power to him, if he's found a way to have someone else pay for it.

AO also may not win a popularity contest, but between the two it can't be disputed there's been some serious enturbulating going on.

Smurf, on the other hand, actively worked with OSA as a plant who disrupted active critics when the kind was a mere handful. Yet here he's labeling others as "sick". Takes one to know one!

AO could do a lot AND be a raging asshole at the same time. Which he is.
He would get more done if he wasn't so full of fucking fail that he repels others.

Wow. Your troll to make you appear like OSA is pretty good. Congrats.
    Nice ad hominem.

What does this have to do with anything? One can only be a good critic now if one engages in legal sparring against the cult? AO and AGP have only been in legal action because they acted foolishly. You don't see most other protesters having to lawyer-up after protesting.

AO and AGP will get into more legal issues. It is their nature. The cult knows which buttons to push to get reactions and AO and AGP are reckless.

When Smurf showed up here (or on Enturb), darned right I made sure that Anons were informed as to his past activities. And then I stopped.

I put down Smurf at the ford, but you're still carrying him. Why is that?

I don't get it. Is dressing up as a black man racist? Is dressing up as a criminal black man racist? And does this only apply to non-blacks?

I mean fuck, the theme for the protest was "pirates" and he dressed up as a somalian pirate that - most of them I can only assume - happen to be black, being from fucking somalia.

Sometimes it's incredible how much people care about fucking skin color. I'll go play Resident Evil 5 now.

That is so flawed, it's not even worthy of a response. It is worth pointing out how fail it is though.

Turns out, the statute of limitations is three years for assault with injury. Broke a nail, twisted my back, bruised my wrist bone.

HEY DM...YOU READY FOR ROUND TWO? GONNA BURN MY LAWYER'S OFFICE DOWN TOO?

Oh right, you can't. My lolyer is fireproof.

For the sake of XENU keep this case simple! Scientology came off their property and used excessive / unlawful force and you were injured and have damages. Just win any case and it is a victory for all.

^ this. So many cases have failed due to trying to include the kitchen sink.

Did we manage to check if all the goons present had the required California security guard licenses? As I recall, there was one who didn't. (I leave that for a high level Thread Necromancer.)
  26. xenubarb Member

I think only Seibold, but it was a while ago.

Gentlemen, as far as "keeping it simple," I tried to preserve evidence of AO's beatdown by trying to take the camera he told security goons to give me. Then I was assaulted. Film at 2008. The attack injured an existing disc problem in my back, I broke a nail and hurt my wrist on Danny's face.

Simple enough? AO sez Moxon will probably make me see a psychiatrist, something I've never done before. "Hey, ever hear of CCHR, doc? Did you attend the psych convention in San Francisco two years ago? You know those guys with masks? I was one of them."

Yeah, I like that idea. See a psych. You betcha. But, on whose dime?

If it were only for the purpose of determining what extent of "emotional distress" was intentionally inflicted, then a psych exam might be fun.

But in the hands of Moxon and Company, the exam becomes an excuse to probe your life history and look for weaknesses to exploit, including the possibility of alienating friends and family and messing up any future prospects of substantial employment. Not to mention, transcripts of the exams make their way into public case files, so anyone who wants can do the same.

What forced the settlement with AO was the continuing prospect of increasing collateral damage to the future interests of Gold Base, like the exposure of their corruption of local governments and the noisy highway they really want the county to just hand over to them as a private driveway.

What court was this filed in?
  29. Smurf Member

    meh.

If Moxon wants you to see a psych, the judge would have to order it and it would be on the cult's dime. Moxon would also determine who you see, but your attorney could weigh in on this.

Your attorney would probably suggest you see a psych on your own to counteract the biased report that would certainly come from the psych chosen by Moxon. It's no secret that defense psychs bend head over heels to please the hand that is feeding them so more work will be sent their way.

XB has a great chance of winning big on this case (judges & jury's do not like to see grown men assaulting women) if she keeps AO out of this case entirely except when her attorney says so. Watch AO try to talk his way into being an important witness in this case.

If everyone who has been assaulted or harassed by these thugs (apparently as a part of their SOP) did what you're doing, sooner or later it would bring them to their senses.

Moxon: "At last the case with AO is settled! Now maybe I can get a day off now and then from my ping-pong schedule..."

    A new challenger appears!

The complaint either hasn't been filed yet with the court or it hasn't been recorded yet. With the backlog of court cases (due to the economy & budgetary cutbacks), it can take awhile for a complaint to be officially recorded in the court database, though Barb's attorney would immediately get a date-stamped copy of the complaint.

You need to get a good lawyer who is not tied in to this crap! As far as seeing a Psych and with my understanding of the law in this type of case is it only applies if you are claiming psychological damages. Mental stress Etc. Even then there are limits to that. For example lets say you had started to pee yourself at night just after the attack and a medical doctor found no physical reason for it and you claimed you were having bad dreams about the attack when this happened as a part of the damages, then a judge might grant Moxons request. Everyone in the world who sues is not automatically granted a Psych eval at the request of a defense. In fact it is harder than ever to get a court to compel this type of thing. Most of the time the court will allow you to submit a Psych eval and it would be up to the defense to bring in experts to attack it. But they can not bring in experts to eval you for things you don't claim!

If Moxon wanted to go the rout and claim you were mentally ill and made up the allegations to get a eval when you were not claiming psychological damages he would need to have compelling evidence. I don't think he can do that as the incident did really take place and is on video. Last but not least the courts and the law are not absolute. Look at Sparrows case and how people on this site swore up and down how the SP Declare, Fair Game and Clyde Andrews were not going to be allowed in the case! All of it happened! People on this board while well meaning and caring are not a subtitle for proper legal advice!

Also stop talking about what AO said as this can be dragged out in court. My advise is don't talk about anything else publicly till you contacted a good lawyer and if they are good they will advise you not to make public comments. I love AO and how he stood up to the cult but a few things really hurt him.

    1. Pissing off his lawers
    2. Talking to people that did not need to know and leaking info. The cult can only attack what they know and the less they know the better as they can not effectively prepare for it or will guess.
    3. Having a good solid lawyer. No insult to Graham who I also love but he was to close to this case.
    4. Letting his lawyers off the hook. Once they sign on they are obligated to give you representation. Moxon WILL TRY TO COME BETWEEN YOU AND YOUR LAWYER! When he does you can file a Bar complaint!

You can ask the court to assign punitive damages and with what I saw on video if I were a judge you would get some despite know that Scientology was behind it.

As certain as Xenu caused Teegeeack to be implanted with enturbulated thetans, Moxon will seek in discovery to uncover all available communications under the name xenubarb and similar, and introduce them in court as evidence of intent to cause a provocation of cult agents.

My guess is that any intended humor will be twisted into probable threats ("Tom Cruise missiles" anyone?) and messages of that sort may run into the hundreds if not thousands.
