Another anvenue available to you is to sue the person who assaulted you in small claims court where the threshold for evidence is by "the propondurance of the evidence" instead of "without a shadow of the doubt". And from what I've read and seen about what happened, you should be able to prove your case. Just make sure you take all relevant evidence with you, especially evidence from 3rd parties such as police and medical reports.

There is no lawyer representation so Mr. Moxon will only be able to coach the witness, not speak for him. You'll get your assaulter to yourself infront of the judge.

And if you argue it right, I think you can split your case up so you can sue for the damage to your personal items in one chunk, sue for medical damages in another, and then sue for pain and suffering in the last chunk to maximize how much you get back under the cap imposed by small claims. Normally it's considered all the same action but I've seen it done before.

Also, what about endangering the child this psycho brought along with him? (not being entirely serious here, but wasn't that the suggestion offered by the Asian ADA who just *happens* to be a Scientologist and just *happened* to be present that day?

Fail.
Damages are limited in small claims, usually no record and no appeal.
The burden of proof (different than the "threshhold of evidence" whatever that means) in all civil cases is preponderence of the evidence not "shadow of a doubt" which is not the standard anywhere. In criminal court its "beyond a reasonable doubt."
Any personal injury attorney would take this case on a contingency fee basis. No fee unless you win.
Everyone should avoid small claims court unless its really small. Tommy's injury is not minor.

Also - I was there, but did not witness event, another anon did stop by and ask if I knew anything about it. But whatever went down it did not strike me as a huge "event" and Tom's a big guy and doesn't afraid of anything.

Wow. It disturbs me that some Anons are using Tommy's past behavior as a reason to deny him help.

Following the same example, taking into account all the times we were rude/disrespectful to our parents as we were growing up, they should never help us again. Doesn't quite work, does it? Every day is a new day.

It is quite likely that this was the response the cult expected. Hence the convenient presence of the ADA in the org, with his inappropriate legal advice. Inappropriate to the situation as it played out, that is.
Had Tommy pasted the dude, it is quite likely he'd be facing child endangerment charges as well as assault, etc.

Many citizen press-release sites like opednews & pr-inside will not publish your work if it's deemed an "attack".
