In reading upon this matter, what consistently stays at the back of my mind is how much of a case does Kim Beloitte have to present to convince a judge she had reasonable cause to fear, be importuned or be intimidated by AS's behavior. How likely is a judge to just take her word for it rather than say "bitch, please, 4 year-olds shrug off bigger and better flames at daycare"?

It brings to mind the case of the million dollar pants guy that sued a dry cleaner for millions of dollars because of an alledged false advertising claim of "satisfaction garanteed" and the judge threw out the argument because the man's criteria of "satisfaction" was unattainable and beyond the realm of reason.

In other words, I ask how much weight could or would KB's flimsy claim bear de facto?

I would think they would require more than her word, which is crap.

But I would love for the judge to say that.

PS: I realize that Sparrow's case is criminal trial and the million dollar pants guy was a civil trial and the level of burden of proof is different, but I hope the legal-eagles here understand what I'm getting at. I wonder how much of KB's claims of being intimidated and fearful or whatever language she used to press charges would be considered in the judge's decision as to whether or not any other reasonable person would have perceived Sparrow's behavior the same way she claimed.

IMO it's a bit of a stretch and harms the real meaning of domestic violence if you allow the term, even just for the bureaucratic convenience of court paperwork, to be applied to non-domestic situations.

Just curious as to why it's only now being listed as DV! It wasn't listed as such a month or so back!! It's incredibly misleading for the average public following updates from the recent Washington Post article etc and it's an insult to real victims of domestic violence!

Would also appreciate statements on their legal stance on persons or groups that intentionally falsify claims of stalking, dom violence, etc. I can't help wonder if NCADV would be interested in cases just like Sparrow's. Manipulation of these laws are infuriating to many because decades of tedious, expensive and time consuming resources were committed to putting protections on the books. Many sacrifices and personal dangers and humiliations were suffered to make it happen after decades.

Yes, this is why REAL victims of sexual & domestic violence seldom come forward! Until our society stops blaming the victim, rape will continue to be most unreported crime and why domestic violence has become intergenerational. There are actually very few cases of women falsely accusing men of these crimes but when they do they receive national attention feed into the rape myth! That's why I loathe a woman like Kim, who is basically falsely accusing an effective protester of stalking her to protect her cult stats!
But in this case I would relish any negative media attention this bitch should (& WILL) get for falsely accusing Sparrow of stalking!
