Anon Sparrow - Criminal Trial Scheduled to begin Feb. 22 2011

So today, Dec. 6, we determined that the criminal trial will begin February 22.

The whole bond review thing is apparently a clerical error of sorts because it has nothing to do with my case.

Next stop is Kim Belotte and Vici Turisi's depositions next week for the civil case - 12/14 and 12/15. I expect Moxon will attend both.

Hi Sparrow! It's friggin' freezin' here in Florida, so you're not missing the sunny decks right now, and too cold for your vintage tropical shirts.

Just wanted to say thanks for putting up with the crap you're dealing with, but know we're all here for you and behind you. I'm gonna go with hoping the tides of justice are finally turning in the world of Scientology vs. Justice.

I know it hurts to find those you once thought of as friends and team mates go against not just you personally, but all you once considered a cause and hope for humanitarian efforts.

From a CDN Law p.o.v, (which is all i can speak to since im CDN & law student)but im sure the US law would be the same...

Attempted Stalking is a Subjective Mens Rea Criminal Offence: which means there has to be an Intention to stalk. Even if Sparrow followed her to her house (which he obviously didnt) the mere fact that he followed her would not amount to stalking or an attempt to stalk.

Mens Reamental element)The prosecuter would have to prove he had Subjectively Intended to stalk. and..
Actus Reus(pysical element): since it's only an "attempt" they'd have to prove he took some steps towards preparing to stalk, even though the steps fall short of the AR for the full offence of "Stalking."

-Moreover, since there was no full Actus Reus (he did NOT actually stalk anyone) the law of 'Attempts" usually puts a higher burden on prosecuter to prove the accused had Actual Intention. ie/ it'll be less likely for a judge or jury to Infer intention from any surrounding circumstance.

Any US law PPl feel free to correct me. But this "Attempted Stalking" charge is beyond Absurd and his Lawyer should be able to Defend this easily by raising a reasonable doubt as to sparrow's intention.... From a Legal Defence POV this is like challenging a mathamatcian to solve 1+1.

On the Civil side... Moxon is so slick and so sucessfull.. ill refrain from commenting.

I pointed this same thing out here, in part one of this thread. You're absolutely right. Sparrow's attorney submitted a preliminary filing a few weeks back that I speculated may have raised this same point.

The same problem/paradox exists with "attempted assault," which some jurisdictions have found to be a legal impossibility because attempting to cause fear and apprehension and actually doing so is assault; while attempting and failing to cause fear and apprehension results in no injury and thus no crime, like a tree falling in the forest resulting in no sound.

The jury instruction will thus be very important at trial.
