‘Darth Xander’ files motion challenging Scientology’s anti-protesting injunction

Discussion in 'News and Current Events' started by CommunicatorIC, Sep 26, 2015.

  1. If the City Attorney were using the exact language of the injunction, it would be Troy Bezazian.

Congrats Xander! Another OSA fail. This week Sarah Heller will have to eat rice and beans and be in a Liability Condition doing Amends.

We tried it once your way, OSA, are you game for a rematch? OSA, I'm laughing at the "homo novus."

Make a filing with Judge Minkoff. Let's have at it. Permanent means permanent, right? What do you have to lose?

Prediction: After Heraldo Antonio Avila leaves the SO, he will start a WISE company that makes special underpants for sea ogres. Around the band will be several Velcro spots that the orgre can attach corresponding Velcro spotted SO shirts to them so they stay tucked in. (See his picture above) The underpants will also have mirror image zippers down the butt crack and front genital area so the sea ogre won't have to pull them down when they defecate or urinate or accidentally put them on backwards, resulting in dev-t.
Both these features will make them look upstat and cut down on humanoid bathroom time, so they can get their stats up.

Antonio's been doing the same thing for 15 years? No moving up any bridge for him.
  6. I wonder if Mr. Pope is related to the AGP?

Wll Scientolgy fight this? I suspect so if for no other reason that "they have nothing better to do". If you are in Scientology and reading this, let that sync in for a moment. Fighting with. 14 year old injunction over a 10 foot space to limit free speech. That is what your organisation is focused on? That is a WIN for you?

Xandar I hope you able to bring someone with you to film you? Just in case they try the 'ol he is doing something illegal BS.
Love to see the reaction on their faces with the next protest.
    Oh this delights me so.

DM must have busted a vein in his head over this one.
They didn't want that aquarium to open near them because they were afraid of "ooglers" being around that area and the Sea Org getting too much of a good look at normal people.
But now people can protest there freely. Will they reroute the Sea Orgers to walk elsewhere? and bus them somewhere else?
I can't see DM putting up with protesters in the area!
He is losing the battle along with his mind.

  11. Great news that the church can no longer use the injunction against you--or anyone. Does this mean the motion is also over? Or are you continuing to try to squash the injunction altogether?

From what Darth explained, the injunction itself still stands. But the City Attorney has decided, unless there is a court order specifically adding a person to the existing injunction, the CWPD are to only enforce it against those listed in the original order. They are to ignore, and not respond, to any complaint from Flag regarding "injunction violations" about anyone not actually named in the original injunction unless they can come up with a court order showing that individual has been added to it by the court.

In short, their BS of handing protesters a copy of the injunction, claiming they've been served, and that it applies to them even though they are not named, is over. Effectively, at this point, the only one who has to be concerned with the injunction is Mark Bunker. But the City Attorney has sharpened the opposite edge of that two-edge sword where the Cof$ is concerned even there.

Note the very first sentence of the City Attorney's letter: "The Honorable Thomas E. Penick, Jr., Circuit Judge, issued a Permanent Injunction on July 21, 2001 involving members of the Church of Scientology and those persons “in actual concert or participation” with them."He makes the point right up front the injunction also applies to members of the Cof$ at Flag, not just those named from the LMT, and they also have a responsibility to follow it's instructions. Which tells me he's not going to play around if the Cof$ continues trying create incidents to get the police involved. They really can't do that without violating the 10 foot rule which applies to them equally. They've been getting away with it up to know, but with the very real potential of the City getting hit with a Civil Rights lawsuit if it keeps up looming, it doesn't sound like he's going to let the cops keep ignoring it. At least that's my interpretation of the letter. IANAL.

Injunction still exists. CoS can still have anyone and everyone served with a copy of it. However, the difference now is, CPD won't get involved with or respond to any calls relating solely to the fact that a protester was served and is protesting at Flag. That means no more being detained and having to talk about the injunction with an officer, or having to provide personal information for an incident report. Now, in order for CPD to respond to such a call, CoS will have to get a judge to add a person to the injunction. That requires a ton of work, and the second they file to do that it immediately grants legal standing to a person to challenge the existence of the injunction 14 years after the LMT folded and everyone left town. It also opens them up to having to pay attorney fees anytime they bring a claim against someone that they acted in concert with Bunker or any other named party based on de minimus contacts such as having dinner or coffee together (and given that none of the named parties actually protests in Clearwater anymore, that's all CoS could claim.) That's a double whammy that I don't see CoS risking.

For all intents and purposes, for anyone not named in the injunction, this message from the chief of police means no one has to worry about getting sucked into any law enforcement or legal proceedings regarding the injunction. Ever. Under any circumstances including, I dare say, someone who actually is acting in concert with the named parties. Even if that were to happen, which at this point I would maintain is an impossibility for myriad reasons, that opens the door to challenging the injunction on the basis that everything's changed since original issuance. This is why they won't file to have me added, why they won't file to have anyone else added. It would put the injunction at risk and they won't do that.

She started off by saying the email was going to be the subject of a blog entry, but by the time I got done talking about the arrest and all that she said she thought it might warrant a news article. We'll see.

I wonder if OSA Flag now suspects that the CPD chief and attorney have been recruited as agents of German Intelligence.
All the work Pat Harney did has come to naught.
Good bye scientology pr area control.

In the old days the usual procedure was to send GObots and "downstats" doing amends projects around to St. Pete Times boxes, put the coins in and grab all the papers that were in the box, take them to a dumpster and throw them away. I don't think that worked out well for them in the long run.

    LOL! Great!! Congrats Xander!
Glad Tampa Bay got the word out.
I still don't understand how an officer can think the sidewalks are church property?
And it doesn't sound like the COS is going to stop calling the police. I DO hope they start getting fined. They should have been fined all along.
Not only at this location but at all the other morgues too where they call the police for nothing and or lie.
Wonder what the mayor thinks about all this too. Is he aware of the letter? His past behavior suggests that he is a pawn if not a somewhat shill for the COS. And that is IMO.

I wish they used another photo tho.
Do not want anyone thinking that the swarm of Sea Orgers and staff that the COS dressed up are ALL publics at the Supah Powah grand opening . lol

Xander is the epitome of a peaceful protester, which anyone can see for themselves in any of his dozens of youtube videos.

    https://www.youtube.com/user/TheDarthXander/videos

The article repeated the Scientology corporation's lie that Xander is a threat 3 times. That was a bit excessive.

The newspaper also repeated the lie that over 100,000 cult members visit the compound every year, without mentioning that experts on the matter estimate that the cult only has about 30 to 40 thousand members worldwide and is shrinking.

  33. Maybe they fixed it at some point but it currently says 12000, which is a plausible figure for how many Scientologists make some kind of appearance at Flag at least once a year.
  34. anon8109 Member

    Thanks for the correction.
  35. Since that figure came from a CoS statement it is actually kind of an interesting admission. Given how hard the CoS pushes people to go to Flag, 12K going per year is wildly incompatible with having millions of members.

While they call the cops on you to enforce the injunction, they are violating the injunction by staying 1 foot away from you. The part of the injunction where both sides are supposed to stay 10 feet away from each other should be brought out more, especially when Scientology violates that at the same time they're trying to enforce the injunction on somebody else.

Relax - its good. Is the article correct in that you've been picketing since 2013? I'm sure you've picketed there earlier, at least since 2011. Otherwise, carry on.

    Awesomness.

    The epic headline itself:

    headline.JPG

The headline is factual. It doesn't focus on Xander, which is good for a number of reasons. 1.Scientologists are more likely to read the article rather than dismiss it as enthetha and move on. More on this later. 2. I suspect that for some in the community, the message itself demonstrates that scientology has "lost" a bit of it's (perceived) power.

    Then, this picture:

    headline2.JPG

I think the choice of a picture was quite thoughtful. Unlike a cult photo of the opening, it shows the big picture. People are corralled. essentially into a smaller area.
Lot's of empty unused space surrounds this corral. I suspect this perspective is much different than the one attendees are "provided with."

Back to the article, and any of those still in decided that it was okay to read, cause it wasn't clearly entheta.

    headline3.JPG
Yep, Xander's message and the news/background of who Jenna is (and the name of her book) just reached a lot of people.

    Epic and good.

Nice, Xander- on so many levels.
